In a decision that could lay the groundwork for an Arizona-style immigration policy, Virginia's attorney general said state law enforcement officers are allowed to check the immigration status of anyone "stopped or arrested." Attorney General Ken Cuccinelli issued the legal opinion Friday extending that authority to Virginia police in response to an inquiry over whether his state could mirror the policies passed into law in Arizona.

"It is my opinion that Virginia law enforcement officers, including conservation officers may, like Arizona police officers, inquire into the immigration status of persons stopped or arrested," he wrote.

The decision comes after a federal judge blocked Arizona from implementing its provision that would require law enforcement to check the immigration status of anyone they stop and suspect of being an illegal immigrant.

Cuccinelli's ruling could justify that kind of policy in Virginia. However, Cuccinelli reiterated in the opinion a prior finding that while state officers have the authority to arrest suspects on criminal immigration violations, they are advised against arresting over civil immigration violations. Overstaying a visa would fall under the latter category.

I can imagine a lot of MS-13 types in NoVa aren't gonna be happy to hear that.

Just head for the docks boys, the freighters that tie up have full crews of middle eastern crews that have a 24 hour liberty,    where do they go, what do they do ????

If it is a legitimate vessel, then the crew members should have already applied for and been issued C-1 or D visas (for ship or airline crew) and therefore they can legally leave the ship for leave.  Just like every other legal non-immigrant, the law requires them to carry proof of their legal status, so there shouldn't be any issue.

And FWIW, Baltimore has a bigger civilian seaport than pretty much anything in VA, including Norfolk.

Uh, how 'bout if you don't have proof, ya just stay on board? I guess that's just to simple for ya, ain't it? Wouldn't want to infringe on a non citizen's rights, ya know, as they seem to have more rights than I do, and my ancestors came over on the Mayflower.

Better yet, let's just get rid of the law of the land and go willy nilly! Just issue terrorists a permit to blow shit up! I'm sure your buddy BamBam would enjoy the revenue!
