H.R. 45 Filed on First Day
« on: January 27, 2009, 09:58:14 AM »

Representative Bobby Rush (D-IL) filed a comprehensive anti-gun wish-list bill in the 111th Congress on it's first day in session. No sooner were the new members of Congress sworn in than Mr. Rush, a former Black Panther leader, file his bill which he calls the "Blair Holt's Firearm Licensing and Record of Sale Act of 2009". The bill has no cosponsors and was automatically referred to the House Judiciary Committee.

If passed, this bill would require that anyone wishing to purchase, own, or possess a "qualifying firearm" - that's any handgun, and any long gun capable of accepting a detachable magazine - would have to be licensed by the state or the federal government in a licensing program managed by the Attorney General. To get a license you would have to prove you're you, provide a passport-style photo, a thumbprint, and take a written exam which includes questions about firearms safety, safe storage, the risks of firearms ownership, and anything else the Attorney General deems appropriate. All transfers would be required to go through a licensed dealer with the exception of occasional gifts or bequests between parents, children (18 or over), and grandparents, or loans of not more than 30 days between "persons who are personally known to one another." (It actually says that. I'm not making this up.) And all transfers would have to be recorded in a "Transfer Record" established and maintained by the Attorney General.

The bill also makes it a crime for a dealer to have shoddy records or fail to appropriately cooperate with any inspectors. It makes failure to report the loss or theft of a firearm within 72 hours a felony punishable by up to 2 years in prison. Failure to keep a firearm locked up in such a way as to keep it inaccessible to anyone under 18 becomes a federal felony too.

With no co-sponsors, even in a totally 'Rat government?  Not too likely, thankfully.  My guess is it will die in Committee.  Remember, they wanted to redo the AWB in the last Congress and that died as well.

All we can do is just keep shining the light on them.

I'd love to write one of my Senators and ask them to Filibuster the hell out of this...  But lets see...  I got Levin, and Stabenow.  Can't count on either of them to do the right thing.

Someone refresh my memory please:  Didn't the SCOTUS find in the Heller case that license requirements to purchase firearms are unconstitutional?

If so, this bill is DOA

What a huge problem this will create.  Can you imagine the 100's of thousands of criminals who will be needing to get their fingerprints and ID's fixed before they comply with a law like that?!  I mean, they already have their fingerprints and mugshots on file so they will all rush out and get these changed right?  They WILL comply with the law like the rest of us won't they??

I'm sure the Der Fuhrer would like this bill to go forward.  It would make disarming the citizenry for the safety of his NAtional ZIvilion Security Force much easier.

This amounts to gun registration. Many of the proposed laws are already on the books and there's a suspicion that the ATF already keeps a record of the Insta-Check requests.
This is pretty much the law already:
Quote
All transfers would be required to go through a licensed dealer with the exception of occasional gifts or bequests between parents, children (18 or over), and grandparents, or loans of not more than 30 days between "persons who are personally known to one another."

The more bothersome idea is this:
Quote
If passed, this bill would require that anyone wishing to purchase, own, or possess a "qualifying firearm" - that's any handgun, and any long gun capable of accepting a detachable magazine - would have to be licensed by the state or the federal government in a licensing program managed by the Attorney General. To get a license you would have to prove you're you, provide a passport-style photo, a thumbprint, and take a written exam which includes questions about firearms safety, safe storage, the risks of firearms ownership, and anything else the Attorney General deems appropriate

And as Texacon inferred, the criminals  aren't going to bother with any "law". The Atty General, if he were serious about the issue, would enact strict penalties against those who commit crimes with a gun.

"The state must declare the child to be the most precious treasure of the people. As long as the government is perceived as working for the benefit of the children, the people will happily endure almost any curtailment of liberty and almost any deprivation."- IBID

Ironically/hypocritically:

Quote
The Black Panther Party (originally the Black Panther Party for Self-Defense) was an African-American organization established to promote Black Power and self-defense through acts of social agitation. It was active in the United States from the mid-1960s into the 1970s.

Founded in Oakland, California, by Huey P. Newton and Bobby Seale on October 15, 1966, the organization initially set forth a doctrine calling for the protection of African American neighborhoods from police brutality, in the interest of African-American justice.[1] Its objectives and philosophy changed radically during the party's existence. While the organization's leaders passionately espoused socialist doctrine, the Party's black nationalist reputation attracted an ideologically diverse membership.[2] Ideological consensus within the party was difficult to achieve. Some members openly disagreed with the views of the leaders.

In 1967 the organization marched on the California State Capitol in Sacramento in protest of a ban on weapons.
http://en.wikipedia.org/wiki/Black_Panther_Party

Mr Rush would see his own former group unable to defnd its own neighborhoods from the excesses of a police state.
According to the Bible, "know" means "yes."
