Secretary of State Jesse White officially rejected Governor Blagojevich's appointment of Roland Burris to President-elect Obama's U.S. Senate seat.

The governor's office says it's now reviewing its options.

Lawmakers on both sides of the aisle generally have good things to say about former Illinois Attorney General, Roland Burris, but they say he's made a big mistake by accepting the U.S. Senate appointment.They believe Burris won't be able to avoid being tainted by the federal corruption charges hanging over the governor's head.

While Secretary of State Jesse White refused to certify Burris' appointment, that may not stop him from taking the Senate seat.

"The governor's office can go in and order him to do what the law requires him to do," said Kathryn Eisenhart, UIS Legal Studies Department Chair. "Then off Mr. Burris goes and then possibly Senator appointed will then go to Washington. If the Senate refuses to seat him, I would imagine that he then goes to the Supreme Court of the United States and they then enter an order requiring the senate to seat him because there no legal reason not to."

the whole thing will wind up in the SCOTUS, unless blago backs away from this appointment.

I dunno, I think Harry "no balls" Reid might blink first.  He can easily say that Burris is a well qualified candidate, and not connected to the previous scandal.

just allowing burris to be seated solves a lot of problems for the dems.  he's african american, he is probably qualified, etc., etc.  the senate is 100% white since the obamessiah resigned . . .

But, at the same time, it paints the entire Democrat Party with the brush of the corrupt Chicago Machine.  The Obamessiah is supposed to bring "change" to Washington, which means that he has to attempt to avoid the taint of corruption (even though he won't).  It's a masterful stroke by Blago; in this, he's saying, "You wouldn't play ball with me, so I'm going to try to limit your Presidency to one term."  If Obama (or Reid) resists the appointment, the Senate Dems can be labelled as racist in 2010 by the Republicans.  If Obama goes along with the appointment, then he can be accused of going with the same old Chicago politics, and not being an agent of "change" at all.  So, Obama will resist it, the Senate will refuse to seat him, and it will go to the SCOTUS.  The conservatives will vote to seat him; the liberals will vote to not seat him.  Once again, it comes down to Anthony Kennedy.

Good analysis!

But I wonder if Reid will also assert that Illinois is entitled to full representation in the U.S. Senate, and that the people must be represented, though he regrets how this was done, etc, etc. As the scandal becomes old news, many will say that Blago has not technically been convicted of anything, and so deserves the presumption of innocence. If Reid caves in, there will be no need to go to the SCOTUS. Obama actually does not have much to say about all this, really, though he will be weakened from it politically.
