Judges Declare Judges Can Grant Immigration Visas, Even When Elected President Disagrees

Judges in the Ninth Circuit Court of Appeals in California are opening a new immigration route for foreigners, which would bypass the federal agencies’ sole authority to approve or decline foreigners’ immigration or entry into the U.S.

The new route is created by the Feb. 9 decision which blocks the White House’s very popular reform of immigration rules.

If upheld by the Supreme Court later this year, the new declaration would allow overseas foreigners — including those hostile to the United States — to hire lawyers to persuade judges to grant them visas, residency permits and eventually citizenship. That courtroom route would bypass denials or approvals from the elected President’s administration and its subordinate agencies, including the intelligence, law-enforcement and national security agencies.

In practice, the decision would give foreigners the right to sue the federal government when they’re denied entry by the federal government. That right, when pressed by many migrants, will ensure that some gain entry to the United States despite opposition from the voters and their chosen government.

That created right to sue for immigration rights would also give the nation’s corps of immigration lawyers more opportunities to trade U.S. citizenship to foreigners in exchange for lawyers’ fees.

MSNBC's Scarborough: Court's Ruling on Trump Ban 'Laughable'

The Ninth Circuit appeals court's decision on President Donald Trump's travel ban was "laughable" as there was no "specific person with a specific injury" involved, MSNBC's Joe Scarborough said Friday.

"They ignored the ruling law," the "Morning Joe" anchor said on his show. "They just as a matter of course gave the state of Washington standings. There's no specific person with a specific injury that is specifically going to be addressed by this action, which usually is how you get standings. The Ninth decided not to last night."

Further, said Scarborough, the decision "radically extended the rights beyond mere green card holders and did something the Supreme Court has never done and extended this to potentially possible new claims for immigrants."

The court's three judges also did not talk about the statute that gives a president power to pass an executive order on immigration, said Scarborough, which is "what you examine to see if he has gone beyond the boundaries."

This, he said, "would be like the court taking a free speech case and not talking about the First Amendment. It was preposterous."

Analysis: Ninth Circuit Would Allow 9/11 Hijacker to Sue to Come to U.S.

The judgment of the Ninth Circuit upholding the temporary restraining order (TRO) against President Donald Trump’s recent executive order restricting travel from seven terror-prone countries would have allowed one of the 9/11 hijackers to sue the government to come to, or stay in, the United States.

Under the court’s novel theory of legal standing, “injuries” to public universities that result from foreign students and teachers not being able to enter the country give the states standing to sue.

Moreover, the court held that foreigners with visas have due process rights under the Fifth Amendment of the U.S. Constitution, even though the precedent it cited applied to people already in the United States. Those due process rights could also be asserted by states on behalf of people in the U.S. illegally or “who have a relationship with a U.S. resident or … institution,” the court held in its ruling.
