Is there a flaw in our Constitution?
Our Founders would not have known what impact technology and social media might have in the future of our country?

Two times, out of the last 5 elections, the popular vote winner for President has lost the Presidency due to the electoral college vote. It has become too common.

Not only is the "electoral college" a possible flaw in our Constitution, but the idea that there are "checks and balances" to somehow protect our citizenry is also a flaw?

It needs to be fixed, in my opinion.

2. I'm interested in the idea that Checks and Balances are a flaw - what do you mean by that?

I have generally thought that they were a good thing.

but, political Parties have become so ingrained in our system of government that Party politics, by a simple majority, can over-ride all checks and balances for benefit of Party. For example, we have a Republican majority by numbers, but in reality, they will ignore the Constitution and give their elected leader dictatorial powers. Conflicts of interest, which is clearly forbidden in our Constitution, are well on their way to being ignored, as the would-be dictator does business with friends and enemies alike.

The FFs were very aware of the power of demagogues (think Athens and the Peloposnesian War!), of voter fraud, and of the potential for greedy arrogant cities exploiting the rural folk who feed, clothe, and house them (= lumber). What you imagine to be a "flaw" was a carefully worked out hurdle to weaken those evils.

Clinton’s top campaign officials note there are 19 states that have voted Democratic in each of the past six presidential elections that account for a total of 242 electoral-college votes. Add New Mexico, whose population is 40 percent Latino and which has gone Democratic in five of the past six contests, and that is 247 of the 270 votes needed to get to the White House.

What happens if the President doesn't sign an executive order on immigration by the end of the year?
We know he was getting a lot of criticism from the Latino community before the election because they did not like him postponing it simply because some Democrats running for re-election did not want to run with that issue hanging over their heads. So the President, because he feels obligated to do so, has decided that he needs to sign an Executive Order before the end of the year.

So what happens if the President decides to give the Republicans time to pass immigration reform on their own without his EO? They are saying it will "poison the well" if he acts on his own. It's almost like they want him to sign an Executive Order so they don't have to bother with it?

But if the President does not do something by the end of the year, will this hurt the President and the Democrats with the Hispanic vote? If the President explains to Latinos that he is giving the Republicans the chance to pass comprehensive reform on their own. And if they don't, he will sign an executive order giving amnesty to the 11 million undocumented in this country? Would the Latino community accept that? Would the Republicans feel any pressure to act? Wouldn't this put them on the defensive to do something about immigration.

I think the President needs to play hardball with this issue. He should offer the Republican a window of opportunity to do something about it on their own. If they don't he can sign an executive order anytime he wants. On the bright side, this would create havoc with the Republican caucus.

If one thinks about it, CA is a microcosm of what the FFs tried to make difficult through the EC. CA has the second largest city in the US, plus 3 more whose populations are about 1M apiece. Meanwhile, CA also has (or had) huge agriculture, forestry, and mining industries. Large-city voters who have little or no understanding of those industries - and don't give a @#$% - routinely and casually vote for regs - directly and through domination of the legislature - that have or are killing those industries.

Very good points.

To further my point, imagine the scenario was the exact opposite.  Hard to envision, but just go with it.

CA, NY, IL, MA were all Republican strongholds and the Democrat party held all of "fly over land".  Would the R's & conservatives be claiming this same crap?  I would suspect not, that Dems would say that they are in charge in far more places than just these few states.
