Judge: Law penalizing fake heroes unconstitutional

7/16/2010, 12:20 p.m. PDT
DAN ELLIOTT
The Associated Press

(AP) — DENVER - A law that makes it illegal to lie about being a war hero is unconstitutional because it violates free speech, a federal judge ruled Friday as he dismissed a case against a Colorado man who claimed he received two military medals.

Rick Glen Strandlof claimed he was an ex-Marine who was wounded in Iraq and received the Purple Heart and Silver Star, but the military had no record he ever served. He was charged with violating the Stolen Valor Act, which makes it a crime punishable by up to a year in jail to falsely claim to have won a military medal.

U.S. District Judge Robert Blackburn dismissed the case and said the law is unconstitutional, ruling the government did not show it has a compelling reason to restrict that type of statement.

A spokesman for the U.S. attorney in Denver said prosecutors are reviewing the decision and haven't decided whether to appeal. The spokesman said that decision would be made by the U.S. Justice Department in Washington and prosecutors in Denver.

This sux. I guess if you get the right judge, anyone can get a ruling in their favor. This needs to be appealed.

I have profound faith – a faith that appears to be questioned by the government here – that the reputation, honor, and dignity military decorations embody are not so tenuous or ephemeral as to be erased by the mere utterance of a false claim of entitlement.

I am sorry judge, but since when does your faith regarding any topic have any place whatsoever in your position as federal judge.

TAH has more on it HERE.

http://pownetwork.org/phonies/phonies519.htm

OK ----They argued that simply lying is not illegal.

What can we get in trouble for lying about in any other field.?

Let's see, Stolen Valor, lying to get into the good graces of the comunity and all the free drinks, food and perhaps discounts on furniture or a car-------few employers demand to see a DD14 any more.

This Judge needs to be slapped, how would he feel if his daughter became engaged to a "War Hero" who was found to be a dead beat that never served a day in the military.?----

There have been cases where men have managed to get documents forged and actually get officer status and be placed in jobs of Military doctors and or in charge of hundreds of men and woman in the service.

ARGGGGGGG,  so if lying about past experience is not a crime when the person benefits from their lie,--say I myself get documents forged  and open a practice as a medical doctor, BUT do not treat patients just hang out at the country club, the chamber of commerce and get in the good graces of the mayor to get a break on zoning, A pass from the building expects, all on the word that I am valuable to the comunity because of a simple lie.---

I am reminded of a time when in VA. there was a very bad 3-4 car crash in one of the tunnels in Norfork.  A woman jumped out of her car and ran to help one of the drivers and told him she was an RN and would help him.   She asked him if he was holding because the police were on their way.  She told him she would help him out but he had to give her his stash and she would go with the ambulance to the hospital and return it to him there.

The driver all discombobulated pointed to the glove box and two bags of 2 pounds of pot stuffed inside.

The RN took the stash and ran for her car and drove off, just a simple lie, no problem there just the drug charges she never faced.

A simple lie, I am an American Citizen, I am a War Hero, I am on welfare and have 9 kids, I have a licence to wire your home, ----Yeah right.

If YOU lie to a cop, you're going to jail. Lie under oath, you're going to jail. Lie about your service record, no problem.

Idiots. TiT is in hog heaven.

Probably be pissed if you're talking about the late admiral who was found not to be in error on the valor devices in question.

That would be him. There are days when maybe the dead should come back and extract vengence against those that deserve it.

Strandlof's lawyer, Bob Pepin, said he hadn't spoken to Strandlof since the ruling was issued. Pepin said he would advise Strandlof not to comment publicly because the case might be appealed.

Don't worry--he'll flap his cocksucker somewhere else.  Guys like him can't help it.
