I am sure many of you have seen the Taco Bell commercial where the guy (we assume a perfect stranger) in the elevator takes a bit our of the main character's crunch wrap.
I was trying to figure out how many crimes that act constitutes. I come up with assault and theft -- anyone have any ideas (also, would the cops take it seriously)?
If someone did that to you or me, would we be legally justified in kicking his ass as protecting our property and selves?

It certainly is theft! But assault? Don't you have to actually touch another persons body for it to be assault? Oh! and yes a crack across the mouth would be in order for the asshole who puts his mouth on my food!

I'm not thinking there was assault, because the guy didn't touch him. But theft definitely. And a total bitch slap would definitely be coming.

I think it is assault in the same way that spitting at you is. They don't have to actually hit you (that is battery).
This is closer to knocking something out of your hand -- which, even though it is not your body, is still an assault on your person.
But it would be interesting to know for sure.

The only crime would be well,theft on the "mooching muncher's" part, and then the other crime of assault... after I decked ol' dude for taking a bite out of my crunchwrap. Although, they ain't that great anyways.

As I understand it, assault is the act of causing "fear of harm" to another person.
