I discovered to day that Walmart charges a sales tax on a non-taxable item. So I
 informed the sales person that the item should not be taxed. I was told that the computer/cash register was programmed to automatically add the tax, so there was nothing that could be done about the tax charge. I guess Walmart takes the opinion that if the tax was to be refunded, then the store would be out of pocket.
 
The Customer service person I talked to was more ready to defend the tax and argue why she thought thwe tax was valid than to apologize or even get to the truth of the matter.
 
So I called Austin and informed the Comptroller's office (who agreed that the tax charge was a mistake) and was told to report the bogus tax charge to the local Tax Enforcement Office so that they could investigate Walmart and see that the practice was put to an end.
 
I called and filed the co,mplaint with the enforcement person and he stated that the matter would be taken care of.
 
I then called Walmart and informed them of my calls. The lady seemed detached and noy interested actually.
 
So I will see if the tax (that no other local super market or any local Dollar General or Family Dollar Stores that I frequent charges) will be removed by Walmart.

CCers:  What do you guess is the dollar amount of the tax?  17 cents?  (he says later on it was a large bag of chips). 

And what is your estimate of the time devoted to this project, given phone calls to the Capitol, and standing in the interminable customer service line at Walmart, going around to Dollar Store doing research, etc.  A week?   :rotf:

How about cost in gasoline and phone minutes?

Sometimes yes sometimes no. As usual with any tax it's complicated.

If the chips sold are meant for consumption on the premises, like a snack area, then they're taxable, but if they are meant to be consumed off the premises they're considered food and are exempt. If the merchant has a snack area in the store it becomes murky as to the intent of the consumer and thus the  taxability of said chips.

Or maybe it's the other way around.

AARRRRRRGGG, now my head hurts.

Anyway, needless to say, Walmart is going down, big time.

Candy and gum are taxable. Candy is any confection made of natural or artificial sweeteners and includes bars, gum, drops and taffy. Candy also includes items such as nuts, chips, hard pretzels, popcorn, raisins and other fruits that are coated with chocolate, yogurt, caramel or similar sweet flavorings.





The Dummy didn't say what kind of chips they were.  Maybe they are taxable.

Only little people, IE working folks preferably of a conservative bent, should pay taxes. The dummies, those mostest, bestest, smartest people on the internet are exempt!!!!

Funny how when it is their ass footing the bill they get all bent out of shape like the rest of us. Maybe the next time the GOP has control of the government they should raise taxes on all liberals and then offer them a one way ticket to Cuba.

I don't think I have ever checked a receipt just to see what is and isn't taxed.  I have compared receipts from store in the city to ones outside the city limits, though.

From the looks of the clientele and employees I see at Walmart, I'd guess 80% to be democrat.
