This is an old bonfire, but a recent comment by a primitive brought it back up to the top of the page.

I was fully approved for my disability claim Sept,2006. The Lawyer was paid over 5,000 and I am receiving my monthly benefits. I have yet to receive my back pay which is in excess of 30,000. The lawyer's answers are always the same blah blah blah but yesterday he advised I talk to my congressman.

Is this a common occurance?

Did you receive any SSI payments? Sometimes there is a delay if offsets have to be applied.

Unless your disability suggests a question of mental competency, there is no reason for your not receiving your past due payments.

Have you tried calling SSA at 1-800-772-1213?

Calling your congressman's office could also be helpful.

If you were approved in September 2006 and haven't received back benefits -that isa year+! It is not a common occurrence. The system is slow but usually not that slow. I think talking to your Congressman is a good last idea/of last resort. Has your lawyer called the SSDI payment processing center- I think it is in Maryland (Baltimore) or Virginia, its easy enough to find out where it is & their number. You may well have slipped through the cracks. You don't have any federal debts do you? Student Loans? Taxes?

The attorney works on a commission, usually.

That $5,000 was probably subtracted from the back benefits.

One has to remember how the primitives think.

It's possible--in fact, damned near probable--the tovaritch primitive "thinks" he's "entitled" to circa $30,000 in back benefits, and has transferred his faulty perception of reality into fact.

I have no idea how this whole thing works, but based upon personal observation (I do income taxes, remember), it actually probably is that the tovaritch primitive was "entitled" to circa $5,000 in back benefits, based upon the time he applied for them. 

The tovaritch primitive, being a primitive, "thinks," probably, that he's "eligible" for benefits going back to his disability (not the date of his application), which might or might not be circa $30,000.

Most such payments, for individuals with no dependents, are something a little under a thousand bucks a month, and at least around here in Nebraska, by the time such cases are settled, there's circa $4-5-6,000 in back benefits "owed" the recipient.

And then of course there's the commission one must pay the attorney--and no matter what else one might say about attorneys, attorneys are really good in telling, up front and in large print, their expected payment.

If anyone more knowledgeable about such things thinks I need corrected, please do so.

Or it could be the tovaritch primitive has governmental debts he conveniently forgets to remember and admit to.

Holy Smoke!  How much do we pay in disability payments??  IF this person is truly owed $30k in benefits how long has it been disabled? 

I have worked with several people who were "waiting for a settlement" and not one of them has come back to buy a home.  I myself was waiting for a settlement not long ago (not governmental ....) and it took a long time to get it then it wasn't near what the lawyers thought it would be in the beginning.  Methinks Frank is right on the money about how much was owed.

A friend's ex-wife was waiting on a slip-and-fall settlement that had gone on for five years.  After the lawyer was through with her, she bought a used Toyota Camry.  :whatever:

I don't view Disability as "welfare" guys. My father, at age 56 (be 57 August), had a triple-heart bypass in January. He's a diabetic and also afflicted with IgA that attacks his liver. After the surgery, he was put on a M-W-F 4-hour dialysis program. It drains him. He can't work anymore. He applied soon after, and has still yet to receive a check, but he has been informed he was approved. This is a man that was in the US Marines from '69-'73 and busted his ass as a parts salesman in the trucking industry since about '73. If he was single, had no kids, and no savings, he'd be ****ed. Hell, if he was your average Democrat, he'd be ****ed because he would have relied on the government and not taken some initiative himself. This is why what government is pimping right now is bullshit. I understand MANY abuse it, but my father, who worked 37 years and paid into the system, isn't going to be receiving "welfare". BTW, there IS no "back pay". Funny that it's the DUmmies pimping this shit like it's the best thing since sliced bread.

No, not all on disability are looking for a free hand out.  There are many sucking on the gov't tit that shouldn't be though.  I had a woman come in my office a few months back, with her husband.  They wanted to rent a house.  She was on disability.  When asked what her disability was her answer was; "I have a social disorder and don't like to be around people".  There it was.  WE are paying her over $1,200 a month to stay away from people.  She had no problem being in my office while myriad people came in and out.  She even struck up conversations with total strangers.   :mental:

I get several a year who come in looking to rent a house who are on disability who have totally bogus reasons to be on disability.  Not my call. I can't deny them housing but it sure pisses me off when I hear some of the reasons.

I also get several a year who are legitimate and it is very obvious.  Some ..... you can't make a call on but when someone tells you they draw disability because they have a hurt ankle?!  I'm sorry but I think a lot of folks on the gov't tit could do some kind of work.  There are others your heart bleeds for and you thank God above you are not in their shoes.

I agree, but in my father's case, I assure you, he paid in more than he'll ever receive.

More of that fuzzy math. He's owed 30,000.00 for 7 months worth of benefits? That's over 4,000.00 a month. What kind of SS benefits is he getting?

There is SSDI (which is a % of what you paid into if you are disabled), and there is SSI (which is for indingent disabled people).   The attorney usually takes the first month entitlement as payment, so $5,000 is quite a bit.   My thought process here is that he has both worker's compensation and SSDI (SSI would never pay out that amount) claims that this attorney is handling for him. 

Nice butt of an attorney to advise that this person contact his congressman.   What has this guy been living on I wonder?

Depends, my bil got 48k in back benefits for the 4 years it took to get them approved. Perhaps someone in the interim gave this fella an inaccurate number, but more likely he has some debt somewhere that it went to first. Another possibility is it got lost in the attorney's office somewhere, but he'd have to actually call Social Security to see if it was ever paid instead of having the attorney do all the work. Could get interesting considering that constitutes, well, you know...work. :thatsright:

I hear you, Rebel. My bil worked hard all his life and then had issues with his liver and back and neck that kept him out of work in the few years before his death. Likewise, my brother is a juvenile diabetic who is on dialysis in the same way your dad is. He is on SSI, but is starting to put his life back together and starting a business with his friend. Still, he's young and it's taken him a few years to not only get used to dialysis, but to plan it in such a way that it doesn't suck up so much of his week(he's done by 10am now on 3 days a week, but still doesn't have energy until about noon). Unfortunately, that kind of thing does indeed limit your options when working so his only choice has been to start a business with his friend since many other businesses would not allow him the kind of flexibility he woudl need for his health problems. I also have a son who is autistic who will likely be getting Social Security at some point depending on his ability to work when he's matured. I don't see it as welfare either, but it has gotten a bad wrap from the abusers of the system--you know the mysterious back injuries and mental conditions, those who can't work because they've let their weight get so out of control they can no longer move in any efficient manner, and those young enough to update their skills from a physical occupation they can no longer work to one that isn't, but they don't. Those individuals have given SSI a bad wrap unfortunately.
