2nd Session of the 51st Legislature (2008)
HOUSE JOINT RESOLUTION 1089

AS INTRODUCED
A Joint Resolution claiming sovereignty under the Tenth Amendment to the Constitution of the United States over certain powers; serving notice to the federal government to cease and desist certain mandates; and directing distribution.
WHEREAS, the Tenth Amendment to the Constitution of the United States reads as follows:
“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.â€; and
WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and
WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and
WHEREAS, today, in 2008, the states are demonstrably treated as agents of the federal government; and
WHEREAS, many federal mandates are directly in violation of the Tenth Amendment to the Constitution of the United States; and
WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and
WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States.
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE:
THAT the State of Oklahoma hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States.
THAT this serves as Notice and Demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers.
THAT a copy of this resolution be distributed to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, the Speaker of the House and the President of the Senate of each state’s legislature of the United States of America, and each member of the Oklahoma Congressional Delegation.

You see, that's the crux of the matter.
I've been watching the successionist Vermonters for a very long time now.
The Vermontese want to be independent of the rest of us, but for some odd reason they think with independence, they can still have Patrick "Joe" McCarthy" Leahy and Jr. in the U.S. Senate, and get all those checks and things from Washington, D.C.
That's a most peculiar notion of independence.
Normally, I would be all for letting the Vermontese go, but not if it means we still have to subsidize them.

Oklahoma doesn't want to secede. They want the Federal govt to mind it's own business when it comes to State matters. This comes on the heels of Oklahoma passing some pretty tough anti-illegal immigration laws.
"The people of the great state of Oklahoma have taken a giant step forward to protect the critical public resources available to legal, taxpaying citizens by passing the Oklahoma Taxpayer and Citizen Protection Act of 2007. Now they want to see it carried out," Curry stated.
The new law helps to keep illegal aliens from receiving public assistance by requiring proof of citizenship or valid visas before being able to get government identification, such as a driver license. Those charged with a felony or with driving under the influence will have their citizenship verified or the U.S. Department of Homeland Security will be notified. The law also makes it illegal to transport or harbor illegal immigrants. Public employers and their subcontractors have to register with a Basic Pilot Program to verify the work authorization status of all new employees.
The U.S. Chamber of Commerce and several Oklahoma business groups recently sued to overturn the law, saying it improperly steps on federal government turf.

That's right, DixieBelle. This all stems from the Federal District Judge/La Raza shill, Robin Cauthron, filing an injunction against two statutes that were levied with the ratification of House Bill 1804.

If more states would follow suit, maybe we can get back to the government our founding fathers envisioned, instead of the monster Lincoln created. The government (fed, satate, and local) tends to too much of our business as private citizens. We can't even fart without asking the governments permission any more.

You will find that Oklahomans are God fearing Americans first, Oklahomans second, and somewhere down the list comes Democrats and Republicans. We didn’t ask to secede. We just want the same thing gays want, our rights. You should demand yours also.
You can’t take one federal dollar without first submitting to a list of demands from Washington.
You want education dollars, no problem, stop all prayer in school.
You want health dollars, no problem, build some abortion clinics.
The list goes on and on. It’s called blackmail in the legal world.
Washington gave $50 to $60 billion dollars to Boston to build the big ditch. That’s more money then Oklahoma has gotten in the 80 years it has been a state.
Oklahoma has taken the first step in trying to reduce the power of the federal government, and Republicans are bashing us. WTH???
This needs to go to the SCOTUS. If we win, we will have Prayer and the Pledge of Allegiance in our schools the next day, and no more abortions.

These are Republicans of the Licoln ilk. Federal Government falls somewhere between the Pope and God himself. They want it minimalized, but until that happens you do as your told. You know, the government will shrink itself if you just wait. No need for the people to buck the system.

Oklahoma has lost almost 130 thousand illegal’s in the past 8 months. You can walk around town now and not hear any Spanish, all day long. The ER’s are no longer full, and wages are starting to climb due to an all American work force. No American will work for $7 an hour, when he can get $9 an hour on welfare.
Seven months ago my MIL died, and I made a trip to the SS office. It was filled with Spanish speaking people. Even the people who worked there , the ones I knew, had been replaced with bi-lingual servants of the people.
I am a pretty big old brawny SOB, but when I think of the years wasted when the repubs were in charge, I just want to cry.
I have been voting since 1960. The only thing I have learned is, if you want change, you better start at home.

Well, if you'd Texans would ever bother learning to read, you'd know it has already passed the House with 92 Yeas to 3 Nays. Even Henry's ol', trusty veto pen for Republican legislation will not be able to stop it.

Growing up in "Texoma-land", (Texas side)`, I'm used to the mix of Okies and Texans (however, they drive like HICKS!! ). I think that Oklahoma done good with this move and the anti-illegal bill recently passed. Too bad that more states don't follow suit in BOTH areas. I DO feel that Oklahoma SHOULD have passed this bill first and THEN the anti-illegal immigration bill.

I say good for Oklahoma. It's well past time for the 50 sovereign states to start telling the Fed to butt out. The 10th Amendment actually does mean something.

I've been waiting a long time for this. I thought it was just a fantasy, though. I had pretty much conceded that states rights were dead. Now, if all 50 will do this, California and New England will hove all the libs and we can live in peace without protests over everything. We may even get our flag back.
