Liberalism at its worst. :mental:

Common sense was fatally stabbed in the 70's and it finally bled out in the '90s. Since then I have been mourning its passing.
-
I'd say "Floriduh" but that kind of ridiculousness is all over the place.
-
So the precious little angels were traumatized. I say good maybe the little thugs will learn a lesson about destroying other people's stuff. Sadly they won't though because they have been made the victims.
In my day my dad would have probably killed me and if I had the nerve to complain that I felt traumatized I would have got in even more trouble.

The worst part is he can only recover 1,500 from each kid for vandalism and it will cost a lot more just to sue the parents

Man Charged After Corralling Suspected Vandals In Closet
http://www.13wham.com/news/local/story/Man-Charged-After-Corralling-Suspected-Vandals-In/jYd7T7t9KEe855zIqqGToA.cspx?p=2
Paul Bowler lives not far from Daniels’ home and the home that was vandalized and he made no excuses for the actions of his boys and their two alleged accomplices when 13WHAM News confronted him.
“No not at all there’s no excuses to be made,†explained Bowler. “I understand they were in the wrong but there are other ways to handle it. He (Daniels) knew who the kids were it's not like they were strangers and send the kids home and call the cops then. You don't sit there and torment them and tell them you're going to bash their skulls in with a hammer.â€
Bowler said his two boys are traumatized by the incident and their mother showed 13WHAM News a picture of the incident that she says one of them drew. Bowler also provided 13WHAM News with a photo of the neck of one of his boys because he said Daniels grabbed his son by the neck and left a mark.
“Oh they're traumatized, they haven't been to school they don't sleep until the sun comes up,†said Bowler.
The parents are just as screwed up. I say charge the parents as well.

vandalism < kidnapping
Not hard to do the math on that one.

He was detaining them until the cops showed up. That is not kidnapping.

I would think kidnapping is abducting someone and taking them against their will.

They have a citizen's arrest statute but I heard the complication was that they were minors and he threatened them. He needs to sue the parents for their negligence
-
They were minors, but they still committed the crime. Do you think they should just walk away with out any punishment?

Yes. That's how they feel.

Felony destruction of property > false arrest (a civil tort)

Of course not but I'm speaking with respect to the legal POV -as I understand the reported facts and I hope he recovers his investment

Face it, facts are facts.
A family is awakened at night to noises on their property and go to investigate.
One member finds 4 kids armed with deadly weapons destroying family property.
The family member does disarm one kid and shoved them into a closet to wait for the police. And I suspect to protect himself as there is no telling what 4 kids armed with hammers could do if they went bonkers on the lone man.
Now we all know what a thrashing screaming 3 year old can do when they refuse to go to bed. This man was facing (4) kids aged 8-10 and from what I see today the kids are getting bigger and bigger every year.
These kids were up to no good, breaking and entering a home and running about destroying everything in site. Sounds to me like they acted like rabid pit bulls, and were very dangerous to anything or anything that crossed their path.
This man has the right to defend his property against anything that threatens it. Age and sex is of no matter especially if the threat is armed with deadly weapons.
These kids were very lucky the man was not armed and the lights were on, otherwise there would be 4 funerals in that town.

vesta111, please report to jury duty because their lawyers are going to dress these boys in altar server vestments and...Thinking about it, I'm wondering if he shot them, without making physical/verbal contact, would he have had 'in fear for his life' defense?

Yes, I think so. Say you awaken to noise and find 4 kids armed with claw hammers out smashing the windows of you new car. Or find 4 kids that broke into a back bedroom of your home in the night.
First though is did these kids find a big brothers stash of heavy drugs ???? I have known some 8-10 year old kids that are 5' 2 " 0r 3" and lots of grown men the same size. I would not want to run into any of the lot especially 4 of them destroying my property in the middle of the night.
Shadows are tricky at night, Poor cop mistakenly killed a 5 year old as the childs shadow made the child look 6 feet tall.
Mouse packs they call the youngsters in the city that want to join a siblings gang. They have to earn their bones and do go out some are armed with knives, a gun or ball bats and 3+4 kids pray on the elderly or the street people.
Hard to believe that kids that young have and will kill someone especially if armed.
With all the hard drugs around and kids finding them it is no wonder children have become just as dangerous as adults, More so as we don't expect a child to come at one with a weapon.
My heart goes out to the Man that walked in on the 4 soon to be criminals. Very brave man to actually manage to get these kids in a safe place to hold them for the police. Yes the closet was the safest place for these kids and verbal abuse of the weapon carrying monsters is the top of ridiculous.
Had he allowed the kids to run home, then he would have no proof they were even there that night. Would have come to a he/said of one against 4 others.
So one parent is angry his kid had marks on his neck, but his kid was holding a deadly weapon, and then the Man had the audacity to cuss them out ?
This Man had every right to do one heck of a lot more to these creepy kids then stuff them in a closet.
Me, I would have held them in the closet for 12 hours or so then called the cops to report I had found the kids locked in the closet but had no idea how they got there.

Clyde man charged after holding young vandals in closet will not be prosecuted
http://www.cnycentral.com/news/story.aspx?id=912090#.UcNfxz7birs
CLYDE -- Wayne County District Attorney says he won't prosecute a Clyde man who corralled four young boys in the closet of a home he found them vandalizing.
DA Richard Healy tells The Associated Press Thursday that after reviewing Jesse Daniels' case, he's recommending to a town justice that the four counts of endangering the welfare of a child be dismissed.
-
Good. Sounds like the DA has more sense than the arresting officer(s).

And more than the current Zimmerman prosecutor.
