Is it time to increase the size of the Supreme Court?
 Today's 5-4 Habeas decision has got me thinking: Congress has the power to fix the size of the Supreme Court. Perhaps the Democrats should use their new embiggened majority to give President Obama a couple more appointments in 2009.

Of course, there's that little detail of winning the election, but I think we need to start thinking BIG about rolling back 28 years of conservative rule.

The DUmmies - in neglecting their study of history - have forgotten that their hero, Franklin Delano Friggin' Roosevelt already tried that during his administration.  He tried to pack the court with his appointees so that his "Progressive" agenda could sail through without a challenge from the Supreme Court.   His magic number back then was 13.  Congress thought "not so much"...

What if the congress added seats to the supreme court and the current court, in a 5-4 ruling, decided that was unconstitutional, or just didn't like it so struck down the law?

I don't get why we even have elections if the Supremes can just make any law they want.

What would eventually happen is that several of the liberal Justices would croak during a 8 year run of a conservative President, changing the court heavily in favor of the Republican appointments.

After the elections of 1936, the Senate (then 96 senators) had 78 Democrats, and the House (435 congressmen), 346 Democrats.

There were only 18 Republican U.S. Senators and 89 Republican U.S. Representatives.

And Congress still wouldn't let him name more justices.

I don't think, with good cause, the primitives know shit about politics.

Sure, why not ?? And while your at it DUmbasses, why not recut the states as well ? Merge the Midwestern ones together, and cut the Liberal ones in to dozens of pieces so you'll have a permanent win situation for all elections via EC ? Wouldn't that be 'teh awesome ?'

The DUmbasses are using the increased population and "diversity" of the country since the mid-19th century as a reason to increased the number of SC justices.  With that reasoning in mind, I suggest we pack the White House with three more presidents, the senate should be increased to three hundred senators, and the house should have thirty thousand districts.  I also suggest all these august people, which the exception of the four presidents, should be unpaid elected or appointed volunteers, and they must all maintain other employment.  I suggest congress be limited to meet in session for three weeks each yearly quarter.  The Supreme Court should meet once a year for the month of August.

“It’s time for Congress to really give Americans the power of one-person, one-vote, instead of the political machinery selecting candidates and electing our president,” Nelson said in a release announcing the amendment.
