Can a company Garnish a worker's wages without informing that worker?
A friend of mine who also works the night shift calls me on his break pissed off. He has been pissed off to begin with because for the past month his paycheck has been smaller than usual. His paycheck is directly deposited so he did try to speak to his manager asking why his pay changed so much.
The manager ignored his calls and request to talk about his pay. His pay stub normally placed in his company "mailbox" suddenly never showed up and no matter how much my friend quested his pay stub it wasn't left for him.
Well, on his break he calls me and tells me his wages are being Garnish and he has no idea who or why is garnishing it. He is deeply concern that his wages are being Garnished by mistake because his older brother had stolen his identity about 10 years ago.
My friend is going to wait until the manager comes in to speak about this issue.
Didn't the company needed to inform my friend this was happening before it started?
My friend has never received anything from a collection company or a lawyer's office.
How does my friend find out who is Garnishing the wages and why?

When my employer started garnishing my wages for defaulted student loan payments, they didn't give me any warning at all. Just one day, poof! A big chunk of my check was gone. Additionally, when I got to the point when garnishment could cease, it was up to me to document this to my employer; the collecting firm didn't proactively notify them and would have been happy to continue garnishing my pay until the full debt was cured.
It seems to me incredibly unlikely that your friend has truly had no advance notice. Unless he has made himself hard to find, it is almost certain that either his lender or hthe collection agency has made multiple attempts to reach him. I'm sure that he insists that no one contacted him beforehand, but he's probably incorrect.

Sure they can start a garnishment without notifying the person. No reason to withold the pay stub, though. I call BS on that, and am inclined to believe this person didn't look into it or even glance at their paystub until it happened a few times and they got curious - finally. A month? Really?
Everybody runs a business. That business is their personal finances. How well would a brick and mortar business do if the owner didn't pay attention to being sure they receive what is owed to them? Yeah. They'd do about as well as this DUmmy.

I have had my wages garnished before there was never any notice it just happened. It sucks but as Frank says, excrement happens one adapts and moves on.

It's not the employer's "fault".
I've had this happen. We get a letter from the state saying "so and so is delinquent on their child support payments; you are hereby ordered to garnish weekly wages in the amount of "x" and deposit them into bank account #xxxx, routing # xxxx; please inform your payroll company of this change effective XXX date.
It's not my business to tell the employee why or even when it's going to start. That's between he or she and the state. I just do what the state tells us to do.

The employer has dick to do with this. The DUche signed some contract and then defaulted on the contract. The legal system went through the motions it has to go through and DEMANDED its employer garnishee its pay. It was the DUche's fault and only the DUche's fault with the kind people there to help it. The employer was totally out of the loop and has no responsibility at all for any of the DUche's self made problems. In fact it is just extra work and cost for its employer.
I swear to God, these are the very stupidest people on the face of the earth.

The few we did all had court orders and one of those was from the state of kalifornia. There is a long time for the DUchebag to plead its case and get off because the debtor/defaulter here is always assumed to be an angel with good intentions and the other guy (except the government) is the devil incarnate.
