Suspect released on bond in shooting death of man who pulled into wrong driveway

Phillip Sailors, 69, a veteran accused of shooting and killing Rodrigo Abad Diaz, 22, in Georgia after he pulled into his driveway was set to have a bond hearing on February 7 but was released on $10,000 bond today, according to his lawyer Mike Puglise.
“Mr. Sailors is not a flight risk,†Puglise says. “A 70-year-old man is not a flight risk. He has lived at the same property for 33 years. He has medical issues and rest assured Mr. Sailors is going to continue to cooperate with the district attorney’s investigation.†Puglise previously told NBC Latino that his client believes his home was about to be burglarized when he shot Diaz.
The victim’s brother, David E. Diaz-Valencia, 23, said, “The guy came outside and my brother’s girlfriend said he was screaming, ‘Get off my property!’ and he shot into the air,†Diaz-Valencia said. “My brother was backing out fast because he was scared and he rolled down the window to say he was sorry and he was not doing anything wrong. Then the guy shot him in his head.â€
The bond decision was signed off on by Gwinnett County District Attorney Danny Porter, who defended the bond and said he did not put any consideration into whether Sailors’ release could inflame tensions after Diaz’s death.

Leave it to a southern DA to let a white murderer go free after murdering a Hispanic. I hope this DA loses his job and career over this.
And to say a 69 y.o. guy is not a flight risk so we'll just let him go---there are plenty of 69 y.o.'s who hop planes to Mexico and S. America every day so how does this DA know this?

I am 66 years old, and I can remember throughout the 1950s and early 1960s when southern newspapers would print photos of lynched colored people. Usually there were a couple dozen or so smiling townspeople, including children, proudly showing off their castrated, burned and hung trophy.
If I, growing up in Seattle, saw these photos every couple of weeks, Sailors, 69 years old, surely remembers them also. He may even have been one of the children shown in those news photos.
Few of these people, easily identified from the photos, were ever charged with murder or brought to trial for any other reason. Is it any wonder that Sailors thought nothing of shooting a person of color?
The stupid is strong with this one.

I just don't understand this mentality when the mere presence of a person on your hallowed private property immediately triggers this violent reflex in people. It is as though these people have fantasized for years about getting away with murder and don't want to miss an opportunity.

All this elderly fellow - who shouldn't have a gun - needs to do is convince one juror he felt threatened he was scared. It's easier to walk in a state with a SYG law, but even without, the argument affects jury decision.

To use a gun as a first option and not as a last resort is absolutely unforgivable. The guy was LEAVING. I cannot imagine what the justification was for releasing his murderer, however old or veterany he was.
Yeah. And if it had been me and all of a sudden the car stopped and the window was rolled down, I would have went to condition Red as well.

That's funny, I was raised in the south, 40's, 50's and 60's and I don't remember all those lynchings.....and pictures in the paper.
The last lynching in S.C. was about 1947 or 48 and Strom Thurmond was governor. He prosecuted about 20 or 25 of the mob......that ended the necktie parties in S.C..

At the same time, I very well recall the photographs in the newspapers and the weekly newsmagazines of the mid-1970s, of hate and racism and violence when the rich whites tried to get the poor whites and poor blacks integrated in schools.....in that fine southern metropolis of Boston, Massachusetts.

I had an uncle, he married my mothers sister, that lived in Rhode Island. Back in the early to mid 60's he used to laugh at the racist hypocrisy of his fellow Yankee neighbors.

The news source for this thread is definitely biased (as are most). We have no idea what transpired except for what the guy's girlfriend said. The DA has both sides of the story & decided not to hold the man. Per her side of the story in the article, I doubt her veracity. For example, if a guy shouts "get off my lawn" and fires a warning shot, I'm going to get the **** off his lawn not roll down my window to discuss it with him.

I'm sorry but the girlfriend's story stinks to high heaven. If a guy comes out with a gun, you throw the car in reverse and beat feet. You don't take the time to roll down the window while you're running.
I bet this story is closer to the truth. They were in the area looking for easy metal to steal and sell to recycling. They had a ready made story where, if they were encountered trespassing, saying that they either had the wrong place or were "just looking for work". There is a chance this old man has been targeted in the past by just such a group of thieves. When they encountered the old man, the driver thought to cover himself in case the old man called the police without thinking of the old man posed a more serious threat.
Anyone want to place a bet?

Change the direction a little.....last Saturday morning, a convicted Obamanite felon here bailed out of jail on an illegal weapons charge killed another Obamanite before dark that same day and was back in jail.
When their criminal record weighs more than they do, the scales of justice should tip toward keeping them in jail.

There are three or four photographs of lynchings that everyone in the world has seen since algore invented the internet.
They took place in the 20s or 30s or earlier, and they were all very illegal at the time.
Around the same time, the KKK was a very popular and powerful political organization in the Yankee states of the Midwest. .
We don't call them DUmmies for nothing.

So do I and the same happen in Omaha during the late 60's and early 70's just not on the scale of the bigger cities. One of the big riots ended up burning down a section of north Omaha that until the late 90's early 2000s businesses stayed out of. It's good to see the DUmp convicting a man without a trial once again. All they have is what the media has printed to go on and nothing else. For all we know the guy may have had every reason to shoot or maybe the man was suffering from Alzheimer's and couldn't tell what that other person was doing . Then again he maybe guilty as hell but they could as least wait for the jury to say one way or the other first.

Might have made a big difference as well if the words that were to come out of the window were in English.
I don't buy the GF's story, either. If he was backing out, meaning the vehicle was in motion AND gear, shooting the driver in the head would make for a very "interesting" ride.
Also, if he was using a GPS, he had to know the correct address. If you pull into someone's driveway, and the number on the house isn't the one one you are looking for, why do you wait for the owner to come out?
Dressing like a human being, and not some hoodrat, goes a long way as well.

There was a program, I dunno, maybe six months ago, about a town down in Oklahoma, on National Palesti--er, Public Radio. The story was about dealing with racism.
Apparently there's some living there still "wounded" by a lynching that took place in.....1908, and it's an open sore.
