Inhofe: Obama Administration 'Doesn't Want All These Pink Slips Going Out 5 Days Before Election'
Obama's Labor Department on Monday issued "guidance" to the states, telling them that a federal law requiring advance notice of mass layoffs does not apply to the layoffs that may occur in January as a result of automatic budget cuts known as "sequestration."
Inhofe noted that if the automatic budget cuts kick in on Jan. 2 -- as they will if Congress can't reach a deficit-reduction agreement -- layoff notices would have to go out no later than Nov. 2. The general election is on Nov. 6.
Under the WARN Act -- The Worker Adjustment and Retraining Notification Act -- companies with more than 100 employees must give 60 days' notice if there is to be a mass layoff during any 30-day period for 500 or more employees (or for 50-499 employees if they make up at least 33% of the employer's active workforce).

Ruling by fiat is the only thing that Obama knows how to do. The SCOAMF will do anything to be reelected.

It would be extremely foolish for an employer to rely on DOL's interpretation rather than playing it safe and sending out the notices in accordance with the apparent requirements of the law. An employer who did as DOL suggests could find itself buying into 100% of the back pay plus attorney fees and litigation costs for the entire period between Nov 2 and whenever the notices actually do go out if its employees disagree with that interpretation and win in court, which would have a very substantial chance of happening.

That's right, DAT. You simply can't trust a gov't official who tells you to go ahead and do it some other way than the letter of the law. What would motivate this private business to withhold the letters anyway? He's looking at a shit sandwich on Jan 2. Not fair to the employees, either, jerking them around like that.
We had a slightly complicated sale of an asset recently. The DMV were all clustered over it. One clerk said to make a bill of sale of zero and "gift" it, even though money did indeed change hands. My husband went ballistic, "you're asking me to lie to the government, and trust you that it's just fine??!!" What a mess. All better now though.
