Quote
The Sacramento Sheriff's Department, which has been spearheading the investigation into the murder of Jessica Funk-Haslam, 13, said parental consent was not required in the DNA collection and interview of minors, several of whom were taken out of class during the day last week at Albert Einstein Middle School.

I really like this part:

Quote
"I think the answer is, kids can consent, and if they consented and it was knowing and intelligent, [law enforcement] can do the search," he told the Sacramento Bee.
How many middle school kids even know their rights:

Parental lawsuit in 3... 2... 1...

I have an issue with it being done without parental consent or knowledge until after the fact.

If you want my DNA or the DNA of my minor child, you'd better have a court order.

I doubt these kids even knew they had a right to refuse.

Since when is a school a place for interrogations and/or questioning for an incident that did not occur at the school?   I would have the school boards ass over this.   Wow.

I thought some cases have been thrown out because of questioning done without parental consent?

As will this one.  You come after my child's DNA, you better have a court order AND my permission to do it.

And after this case is tossed, I want a court order for my child's DNA fingerprint to be expunged from the system.

Impossible in an Orwellian system.

Impossible in an the Orwellian system in which we currently live.

Agreed. Our beloved nanny-state's own rules state that the government agencies using/running the NICS database are prohibited from storing records on people applying to buy firearms, and yet how many times has the ATFE alone been busted for doing just that?

The "DNA database" they've been trying to construct - by swabbing down EVERYBODY who books into and holding facility for any amount of time, regardless of the charge - will be no different.  Once they have it, there's no possible way they're giving it up.

I thought the law was that if the individual is a minor, you are required to have a parental consent to get DNA? I can see a law suit over this one for sure. It will be on the school board and police to are doing the investigating.
