Worker injured during sex gets compensation payout
A WOMAN who was injured while having sex in her hotel room during a work trip is entitled to compensation.
In the Federal Court today Justice John Nicholas ruled that the woman was injured during her “course of employmentâ€.
The woman’s barrister argued that sex was an “ordinary incident of life†in a hotel room, much like showering and sleeping.

A WOMAN who was injured while having sex in her hotel room during a work trip is entitled to compensation.
In the Federal Court today Justice John Nicholas ruled that the woman was injured during her “course of employmentâ€.
The woman’s barrister argued that sex was an “ordinary incident of life†in a hotel room, much like showering and sleeping.
The Judge ruled that “if the applicant had been injured while playing a game of cards in her motel room she would be entitled to compensation†and the fact that the woman was engaged in sexual activity rather than some other lawful recreational activity while in her hotel room does not lead to any different result.
The woman, who cannot be named, challenged the rejection of her workers' compensation claim for facial and psychological injuries suffered when a glass light fitting came away from the wall above the bed as she was having sex in November 2007.

I agree. very topical.
Laws are odd in America. Say a boss decides to have a party where all employees are expected to attend, he has a open bar, one of the employees gets drunk and has an accident on the way home. His negligence to monitor the employees is the same as a bar that serves a drunk customer.
When a boss sends someone out of town they cannot forsee them getting drunk, raped or mugged, but as they were there on company business, what ever hapens to the employee while on company business is covered in the company Insurance. [ as long as the employee did not break the law, or company Policy ]
Interesting as few company's that send out employees on business trips have few rules of deportment for the employees as long as the employee is within the law of where ever they are sent to.
Check out the up and coming law suits the SS will file on their realise from duty due to the scandal that is up and coming. Going to see some fast talking lawyers for the SS and the service men accused in this. Everything from Federal Labor laws to privacy will come up, this can become a glue your seat to watch all the hearings held on TV.

With the way judges are, i'd say it's a crap shoot. Sure it might be denied originally, but in the courts it may get through.
