He's daring them...almost threatening them not to find his mandate Constitutional.
Anyone here want to lay odds on whether when the mandate is sturuck down he doesn't try to fire the entire SCOTUS and replace the current 9 with 9 that will vote his way every time?

I understand they are a co-equal part of Government to the President...if this scenario were to (God forbid) come to fruition I could see him going on TV and announcing that by Executive Order he has dissolved the current Supreme Court and has sent to Congress the names of 9 new justices...and that he encourages their swift and unanimous approval to the bench. Then finish up his brief TOTUS apporved message by saying something along the lines of "The health of this nation and it's people cannot be decided by the political whims of 9 unelected activist lawyers. The law was democratically passed and I intend to see it fully implemented. Which is why I've taken this extrodinary step. Thank you."

I was watching the clip of him last night bitching about the SCOTUS and judicial activism... I was thinking to myself; are you ****ing kidding me? Our side generally says something about it when a ruling is unconstitutional... but then it's not judicial activism to you as long as it's something in your agenda. But when something that is clearly unconstitutional that you had passed into law is on the verge of being struck down then it's judicial activism? OOOOKKKKAAAYYYY!

To which the US Military should step up and detain his sorry ass for being a domestic enemy. One of their charges is to protect and defend the US Constitution and that would be a violation of the US Constitution. Not to mention they'd rule his EO as unconstitutional.

That's also part of the presidential oath.
"I, name, do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and I will to the best of my ability, preserve, protect, and defend the Constitution of the United States."
No where does it say that he/she is supposed to change the Constitution to serve his/her purposes.

Being petulant about it isn't going to make him look good, and his claim that shooting down his overreaching law is "Judicial activism" is wildly off the mark. There is zero chance that he would be able to screw with them in any direct way for revenge, though, since that would require legislation that would have absolutely no chance in the House and slim-to-none in the Senate. Not all of the Dem Senators are the complete legislative whores he would need to pass this, though I exclude Reid and McCaskill from any such group with actual 'scruples' or 'principles.'

There's a political angle to this issue, in addition to the obvious one vis a vis SCOTUS and its constitutional duty to interpret the law.
It could well be that Barry and his Chicago thugs already see the handwriting on the wall (Obamacare will be struck down in toto) and thus intend to remove this legislation as an election talking point -- except, of course, to point out that Romney championed Obamacare at the federal level, even though Romney now says he'll repeal it. :whatever:
In other words, this goat**** legislation will be removed from the political spectrum leaving bin Laden's corpse, Barry's lies about increased drilling for oil, and just recently, some kind of bullshit crackdown on illegals that are known serious criminals (leaving the illegals that are presumably less serious criminals (since, after all, they're illegal) completely alone) as sidebar issues that make Barry look more presidential.
The lies and spin enacted by Sandra Fluke has had a serious effect on women, who now appear to be waffling and are heading back to the Obama camp (women, after all, were central in electing Obama to begin with), according to Bret Baier's program on Fox yesterday.
So all of these things (the lies and spin, principally) will serve Barry well as the average voter is too stupid to recognize how he's being swindled.

He said, "You go back and tell your boss that this business of trying to centralize everything stops here and stops now." FDR was enraged, and that's when he tried to pack the court. After he kicked the bucket came the term limit.
I was dumbfounded by this today. I don't believe we've ever had a president who thought of himself as King of the World and Emperor of All. I anticipate some great and scathing commentary in the days ahead, by better writers and thinkers than myself. I hope there's a stinging backlash.

On 27 May 1935, in the court case of Schechter Poultry Corp. v. United States, the Supreme Court held the mandatory codes section of NIRA unconstitutional, because it attempted to regulate commerce that was not interstate in character, and that the codes represented an unacceptable delegation of power from the legislature to the executive. Chief Justice Charles Evans Hughes wrote for a unanimous Court in invalidating the industrial "codes of fair competition" which the NIRA enabled the President to issue. The Court held that the codes violated the United States Constitution's separation of powers as an impermissible delegation of legislative power to the executive branch. The Court also held that the NIRA provisions were in excess of congressional power under the Commerce Clause.
Specifically, the Court invalidated regulations of the poultry industry promulgated under the authority of the National Industrial Recovery Act of 1933, including price and wage fixing, as well as requirements regarding a whole shipment of chickens, including unhealthy ones, which has led to the case becoming known as "the sick chicken case." The ruling was one of a series which overturned some New Deal legislation between January 1935 and January 1936, and which ultimately caused Roosevelt to attempt to pack the Court with judges that were in favor of the New Deal.

Bret Baier interviewed Carney yesterday and I was actually impressed that Baier could actually sit there in a semi-heated exchange and not gag on the sheer amount of bullshit that Carney was shoveling.
Ostensibly, according to Carney, Dems aren't the irresponsible turds vis a vis the budget process. Baier ripped Carney a new asshole, however, and you could see in Carney's facial expression that his anal orifice was noticeably newer. Musta been all that air escaping.
