OSHA is another Obama agency gone rogue (http://washingtonexaminer.com/opinion/op-eds/2011/10/osha-another-obama-agency-gone-rogue)

Quote
Picture this scenario: One day, in a large hospital with thousands of patient visits per year, the unthinkable occurs -- while a doctor explains unfortunate news to a patient's family, a relative pulls a gun and mortally wounds the doctor.

That hypothetical scenario would be terrible enough. But now imagine that, in the midst of the hospital trying to recover from this tragedy, a federal Occupational Safety and Health Administration investigator arrives to conduct an inspection.

After months of interviewing employees, reviewing documents, and taking videotaped tours of the hospital, OSHA issues the hospital a citation and fine (!) on the basis that the violence was foreseeable and the hospital did not do enough to prevent it.

As you may have guessed, the above inspection is not so hypothetical. >>>

If you're wondering where to look up the federal law or regulation that tells employers how to avoid a citation for workplace violence, don't bother. OSHA has issued this directive under the assumption that a vague clause of the Occupational Safety and Health Act gives OSHA the power to cite employers for something as specific and unpredictable as workplace violence.

Known as the "General Duty Clause," >>>

Now, OSHA seeks to take the General Duty Clause one step further, and to use it to hold employers liable for actions taken by people who are not their employees. This is troublesome for two reasons. >>>

Another fine example of the unnecessary, overbearing new communism via governance-by-agency which this regime has raised to an art form. And whats the old saying? 'Those who can, implement real workable safety measures. Those who can't, inspect.'

Where I work, I'm the poor bastard that has to deal with OSHA when they show up.

As did I, when I was working, however after a couple of contentious visits, I developed a system........upon arrival I handed them a letter (on company letterhead) that read as follows (paraphrased):

"You and your agents have the regulatory minimum of one hour to  complete your inspection of this facility of "x" square feet, employing "y" employees.  You should be further aware that our facility falls below the minimum in both size and staff, as well as function, for routine OSHA inspections, we are therefore allowing this as a courtesy.

Attached to this letter you have a complete list of names and home addresses of all of our employees, should you wish to interview them, you can do it on their own time, if they allow you to do so......

Any documents that you wish to copy will be made available, however, we will require a $1.00 per page paymennt in advance for each copy made on our equipment (vouchers are not accepted).

Finally, you now have only 59 minutes before I call security to have you escorted off the premises......"

They never conducted another inspection after that.......

Yeah....I know all about that......we were part of a larger corporation as well (albeit decentralized in management).

I was also raised in the school of......"you can have all the authority you can usurp.......", which served me well over the years (as well as making me somewhat unpopular). :-)

The only federal government agency that I have had to deal with on a consistant basis in recent work history was the FCC, and generally they were a great bunch.

They COULD do quarterly inspections on all of our facilities, however I short-circuited that by hosting a big barbecue at our shop once a year, and inviting the entire FCC KC field office (down to the secretaries, and their families), got most of them shitfaced and well fed, They could wander around the facilities, and inspect all they wanted, but ironically they spent most of their time at the bar..........and we never had a problem.

I can see how that would work terrifically and it would appear that you had access to the checkbook. Alas, I do not where I work and where I work, we do a magnificent job in trying to make the Indian ride that buffalo......

Actually, OSHA hasn't darkened the doorway since 08 and he was in long enough to say he'd been there. FDA has completely forgotten about us (they were in the plant some 22 years ago -- so long ago there aren't even any records on file), and I'm touching wood as I'm writing all this....

I just reported unsafe work areas to OSHA for ya and called the FDA saying that y'all aren't following CFR 21, parts 10 and 11.

Just thought I'd help you out  :cheersmate:

Sorry I thought you were on the paper work side of the house.  Part 11 had everything to do with us at the pharmacuetical plant for procedures and such.  It actually made things highly difficult for us to perform our jobs in a timely manner.  I was just thinking FDA

21CFR Part 11 has to do with Electronic Records and Signatures. 21CFR Parts 210 and 211 have to do with FINISHED pharmaceutical manufacturing. I've worked in all of those, along with Part 820 (which is current, as I'm a QA guy principally), and API manufacture, which falls under ICH Q7A (which FDA recognizes as a notable standard, but is not a legal requirement).

The OSHA bullshit is just another ****ing hat I wear.  :whatever:

Ive heard said that the CEO of Burlington Northern Railroad says that regulations from all of 0bama's regime regulator agencies have choked the life out of private sector business. He sits on 0bama's inner circle of business advisers. And that 0bama doesn't listen to anyone. Big surprise right?

So thats what? 240 years of liberty run over roughshod by a a rogue government with a would-be dictator for president?

And what great timing ... the House and Senate repuke 'leadership' couldn't be any weaker .. or in bed with these clowns, depending on your view.

Lucky us.  :hammer:
