Title: Alleged Tucson shooter ruled incompetent to stand trial

Shooting rampage suspect Jared Loughner is not mentally competent to stand trial on charges he killed six people and wounded Arizona Congresswoman Gabrielle Giffords, a federal judge ruled on Wednesday.  Loughner was hustled out of a federal courtroom in Arizona on Wednesday after an outburst during a hearing to determine whether he is competent to stand trial.  Loughner, 22, is charged with opening fire at a political event outside a supermarket in January, killing six people and wounding 13 others, including Arizona Congresswoman Gabrielle Giffords.

U.S. District Judge Larry Burns is to decide whether the 22-year-old college dropout, described by his own legal team as "gravely mentally ill," is capable of understanding the proceedings against him and assisting in his own defense.

Appearing unshaven in a beige prison jumpsuit, Loughner rocked back and forth in his chair as the hearing went on, then interrupted the proceedings by blurting out, "Thanks for the freak show" or "Thanks for the free jail" -- courtroom reporters were divided on what exactly he said.

"She died in front of me," he continued to yell, adding, "You're treasonous," or "You're cheating us," as he was dragged from the court.

Is anybody really surprised by this?

I'm not....but apparently Fox News was. Shep Smith and the 2 lawyers he had with him were. According to them, it's highly unusual for someone to be declared incompetent to stand trial in a federal case.

I haven't done the research, but I'm still kinda wondering about the legality of the shooter having killed the judge and the likelihood of the death penalty in that the judge was performing his official duties -- or not.

There was some debate about that, even to the point that Barry may have jeopardized the prosecution because of his DOM.

But I suppose that doesn't matter at this stage. I don't think there's any reasonable doubt that Loughner is a raving lunatic.

The statistic used to be that only one percent of one percent got by with the "innocent by reason of insanity" plea.  Life in one of those wards wouldn't be good, IMO.  I did an internship in one for 3 months.  Honest!  I was an intern not an inmate!  They were very tormented.  I'll let God do the figuring out whether they knew what crime they were committing. 

I felt nothing for them.  Neither sympathy, fear, nor disgust.  Of course, for the fear factor, I had four guards every time I treated someone there.

He may well have voted Democrat, but he may not have been able to make informed decisions, either.  Hard to tell what his brain told him to do.  I'm not surprised at the ruling.

Am I missing something? 

If the guy is really a nut case I totally agree he belongs in a nut house and off the streets permanently. 

What I question is this.  I did not read anything about testimony before the judge.  Certainly had both sides presented legal arguments pro and con for him standing trial and then the judge decides, I am cool with that.  What I read was he was in court, acted up, got hauled out and the judge made a ruling.  If that is true, I seriously question the judge's medical competency to make such a ruling and his legal competency to rule without even seeing all the facts from both sides.  Of course his defense team said he was a nut case and questioned his sanity.  They may have just pulled off the charade of the decade with this one and done their client one huge favor.

If you are genetically predisposed to psychosis, drugs(especially pot) can push you over the edge into a break. Alot of people who suffer from schizophrenia self medicate with drugs and alcohol because it "quiets the voices" Very similar to a person with depression drinking alot. Alcohol is a depressant on it's own so it makes the depression worse. The same is said of using drugs when you have a predisposition to psychosis...it makes it worse but the person suffering from it gets some relief. I don't think they have ever been able to prove that drugs cause mental illness..It obviously does make it worse ,as any substance that causes a brain disturbance usually does.

Abusing LSD and other psychoactive drugs can cause symptoms that mimic schizophrenia.  And that shit he was writing?  Blotter paper and brown acid all the way.

I believe the article said that the judge went on the testimony of a psychologist and a psychiatrist -- two separate people.

I don't believe any competent judge would even think about rendering such a decision unless he's got expert testimony. Well, maybe except for that cast of characters in the 9th Circus.

In the rest of the news: Sarah Palin brought up on charges for thought crimes. Global warming scientists prove her campaign poster with targets on it was really a subtle message sent to Loughner ordering him to shoot Giffords. Scientists also prove similar democrat posters were simply campaign rhetoric. Oh, and global warming is real. We mean it. And last week she clubbed a seal. Really!
