Title: Florida Judge Refuses To Halt New Healthcare Law

A federal judge in Florida on Thursday refused to order the Obama administration to stop implementing its far-reaching healthcare law, a small victory for President Barack Obama in his high-stakes effort to overhaul the U.S. healthcare system.

But U.S. District Judge Roger Vinson ordered the administration to seek an expedited appellate review within the next week of his January 31 ruling that favored arguments by 26 states that the law's requirement that Americans buy health insurance starting in 2014 or pay a penalty was unconstitutional.

Actually the initial press releases are not totally correct.  The judge simply issued a seven-day stay, before he will enforce his constitutionality ruling.

He's basically admonishing the Obama administration for not filing an appeal, and continuing with their implementation.  Simply stated, if the Obama Administration doesn't appeal for an expedited review, he will ORDER states to stop going forward with the law.

A small victory, and a very temporary one at that.  TVDOC is right.  And he can call federal officials on the carpet and even hold them in contempt.  And Judge Vinson does have the right to put implementation of the law on hold if the administration doesn't jump through the necessary legal hoops, and pronto.

Basically, Judge Vinson gave the Obama administration a callout.

No, Sir, he does not have Vulcan ears.  Vulcan ears are pointy, as was frequently pointed out by Doctor McCoy, while POTUS's ears are simply large for the size of his head.

Yes, as Sparky aptly points out Vinson granted a stay for 7 days BUT only on the condition that the Admin. file an appeal within that period that requests expedited appellate review.

The article finishes with: This is a serious strategic loss for the government. Judge Vinson has challenged the federal government to speed up the appeals process, which would normally take much longer, forcing the hand of the Administration, which would like to slow down the litigation through questionably legal tactics if it can get away with it so it can implement as much of Obamacare as possible before it gets to the Supreme Court. As Judge Vinson correctly observed, “t is very important to everyone in this country that this case move forward as soon as practically possible.” Important to everyone except the Obama Administration.

Mark Levin explained this ruling in depth last night, he was furious at ABC's reporting of it and misrepresenting what the actual ruling was.

Im a member at the Heritage Foundation. Great resource.

Luv Levin too. I try to listen to him at night as Im falling to sleep as hes on here between 10pm-1am EST. Or I just download his show and try to listen the following day if I get a chance.

Hes definitely 'show prep' for the rest of the 'back benchers' the following day.
