GRAND RAPIDS – A federal judge today ruled that the state's medical marijuana law protects legal users from arrest, but not employers' policies that ban use of the drug.
Joseph Casias, who has an inoperable brain tumor, was fired by the Walmart store in Battle Creek after he failed a drug test.
“The fundamental problem with (Casias') case is that the (medical marijuana law) does not regulate private employment,†U.S. District Judge Robert Jonker wrote in a 20-page opinion.
“Rather, the Act provides a potential defense to criminal prosecution or other adverse action by the state. … All the (law) does is give some people limited protection from prosecution by the state, or from other adverse state action in carefully limited medical marijuana situations.â€

5. Unfortunately that's the risk of "at-will" employment........
Its not the issue of WM canning the guy for his use of his medicine, its that "at-will" employment leaves too much discretion to the employer. The "at-will" is where the problem lies, and in this case WM was the judge, jury and executioner. The dude should've been able to use his medicine and keep his job, but labor laws in this country are set by folks like WM and their lobbyists.

Walmart met resistance in the Milwaukee area and we get the commercials on Milwaukee television about what a great company it is. I am sure this will not be a topic of an upcoming piece of propaganda.
I have a feeling that even if pot was legalized nation wide, many companies would still prohibit it's use.

I've had plenty of legitimate patients that wouldn't need that kind of headache to deal with.
Maybe so but the police can still arrest you for possession. Federal law supersedes state drug laws.

Holder is threatening Calif. if they proceed with their marijuana laws.
It's kinda hard to figure which laws this regime will enforce or ignore.

But right now there are almost as many pot shops as there are coffee shops out there. Then there is the whole "sanctuary city" thing. Of course, President Bush did nothing about those either. Me? I'd cut all federal funding to them.

You druggies just don't get it do ya? An employer does not have to take liability for a drug addled employee, unless said employer of the employee "knowingly" allows the employee to **** up on the job!!
You drug addicts want to be able to show up on the job high! Ain't gonna happen! I'll tell ya what, if ya want to smoke the herb or take the drug, y'all take out your own insurance that absolves your employer of any liability! How much money ya got? I'll lay odds the insurance would cost more than ya make! That, or ya wouldn't find anyone willin' to insure ya!
