A federal judge in Florida has struck down as unconstitutional key parts of the sweeping health care reform bill championed by President Barack Obama. Officials in Florida and 25 other states are challenging sections of the Patient Protection and Affordable Care Act, including the "individual mandate" requiring most Americans to purchase health insurance in four years or face stiff penalties.

The mandatory part is unconstitutional and inseverable , therefor the whole law is unconstitutional. No injunction issued, so it will go forward on appeal.

I'm not wild about Romney either. I wonder why he ends up in the high end of the polls for the potential candidate?
What especially irked me about Obamacare was that nightmarish "flowchart" that doesn't even fit on one page. You've all seen it. Imagine dealing with that when you've got a life-and-death situation with a loved one or yourself.

It is right now -- the part where residents are fined for not having health insurance. What is happening in MA is not Romneycare. Deval Patrick owns this disaster.

"It is difficult to imagine that a nation which began, at least in part, as the result of opposition to a British mandate giving the East India Company a monopoly and imposing a nominal tax on all tea sold in America would have set out to create a government with the power to force people to buy tea in the first place. If Congress can penalize a passive individual for failing to engage in commerce, the enumeration of powers in the Constitution would have been in vain for it would be “difficult to perceive any limitation on federal power†[Lopez, supra, 514 U.S. at 564], and we would have a Constitution in name only. Surely this is not what the Founding Fathers could have intended."

JUDGE WHO? -- The White House says a ruling by a federal judge against the new health care law is an example of judicial "overreaching" and "activism."
"This ruling is well out of the mainstream of judicial opinion," Stephanie Cutter, an assistant to President Obama, wrote on the White House's blog after Judge Roger Vinson in Florida ruled that the entire law is unconstitutional. "Today’s ruling ... is a plain case of judicial overreaching. The judge’s decision contradicts decades of Supreme Court precedent that support the considered judgment of the democratically elected branches of government that the Act’s 'individual responsibility' provision is necessary to prevent billions of dollars of cost-shifting every year by individuals without insurance who cannot pay for the health care they obtain." Cutter accused the judge of putting "all of the new benefits, cost savings and patient protections that were included in the law at risk." She added, "We don’t believe this kind of judicial activism will be upheld and we are confident that the Affordable Care Act will ultimately be declared constitutional by the courts."
The Justice Department said it will appeal the ruling.

It does -- what Romney needs to do is get in front of a camera and make the case that Romneycare was a mistake- until he does that, there will be little he can do to earn the nom in the end.

ABC, CBS and NBC on Monday night devoted more than half of their evening newscasts to the turmoil in Egypt, but while CBS and NBC squeezed in brief mentions of how a federal judge agreed with 26 states that the entire ObamaCare law is unconstitutional, ABC’s World News didn’t utter a syllable about the major setback for the Obama administration. Anchor Diane Sawyer, however, made room for a full story on an impending snowstorm and four minutes for a new series, “Families on the Brink: What to Do About Mom and Dad?”
While CBS anchor Harry Smith provided a short summary of the development, the CBS Evening News allocated four times more time to new USDA dietary guidelines which call for less consumption of salt. Smith tried to downplay the significance of the ruling.
