January 24, 2011 (CHICAGO) (WLS) -- The Illinois Appellate Court ruled Monday that Rahm Emanuel is not a resident of Chicago and is therefore not qualified to run for mayor
:lmao:

Sun-Times... (http://www.suntimes.com/news/metro/3469419-418/emanuel-appellate-mayor-ballot-chicago.html)
Rahm Emanuel was thrown off the ballot for mayor of Chicago today by an appellate court panel, a stunning blow to the fund-raising leader in the race.
An appellate panel ruled 2-1 that Emanuel did not meet the residency standard to run for mayor.
Appellate judges Thomas Hoffman and Shelvin Louise Marie Hall ruled against Emanuel. Justice Bertina Lampkin voted in favor of keeping President Obama’s former chief of staff on the Feb. 22 ballot.
“It’s a surprise,†said Kevin Forde, the attorney who argued on Emanuel’s behalf.

That's the down side of being conservative...you have to own up to your mistakes.

Thought I just did that. :-)
But yeah, you're right. You wanna dance at this party? Ya gotta pay the band.

They're appealing though, have to wonder if this will be overturned.

How long til someone associated with the denial is "investigated" by the WH? :lmao:
-
Mosley-Braun will keep up a proud Chicago tradition - she's as crooked (at least with her taxes and her campaign funds) as the day is long.
She was actually senator for one term till Illinois got tired of her ass after six years and bounced her.
Now Chicago gets to reap what they've sown.

Either that or Rahm farted.

Looks more like, "Oh boy, I'm next!" or "Wow, I'm having my picture taken with Rahm Emanuel and the President!"

If he hadnt been so greedy, he wouldn't have rented out his house and could have reasonably claimed Chicago as his main residence.
As it is, he may not be on the ballot, but $10M (in campaign donations) is a nice consolation prize and he can run for congress next year.
However the Illinois Supreme Court will probably overturn this decision and Emanuel (dead fish) the tiny ballerina will be allowed to steal the election as predicted ... or he could just return to DC as The Chief Regime Advisor.

Bingo on the first comment, Janice. He should have at the very least rented a townhouse or something. Lord knows he's got the cash.
The ballots are being printed as we speak, and Rahmbo's name is not on it. A lot of things could still happen, especially at the Illinois Supreme Court level. However, there may be a turd in the punchbowl waiting for Rahm there too. The wife of an arch-enemy of Daley/Rahm is on the IL Supreme Court...who knows how she might rule.
If he doesn't get back on the ballot, I'd put my money on Gerry Chico to win over Braun. She has WAY too much baggage, Chico is well respected.
But it is Chicago so who knows what might happen.
-
Yeah, it's a crapshoot...IL state government is not Chicago, nor is it entirely straight up either. No bet on how this one comes out. I heard he was trying to analogize his appointment to military service, which is really a bridge too far in terms of legal argument, there are specific State and Federal statutes that underlie military residence issues which clearly would not include him.

Yeah, this is a complicated issue. Policemen, firemen, teachers in the city of Chicago are required to live in the city, not the burbs. Not sure about all city workers, but clarifying this stuff may open up a whole other can of worms.
Rahm's lawyers were trying to use the military service angle (service to your country), and apparently failed at the current level the case is at.
-
Oh noes! A corrupt Chicago politician unable to run for office! The horror!

Supreme Court: Emanuel stays on ballot while his case is considered (http://www.suntimes.com/3483600-417/emanuel-court-illinois-supreme-appellate.html)
The Illinois Supreme Court has ordered the Chicago Board of Election Commissioners to put Rahm Emanuel’s name back on the mayoral ballot.
The court has not decided whether to hear Emanuel’s appeal of Monday’s Illinois Appellate Court ruling that tossed him out of the race to replace Mayor Daley. But the Supreme Court granted Emanuel’s motion for a stay of the ruling.
“The appellate court decision is stayed,’’ the Supreme Court’s order reads. “The Board of Elections is directed that if any ballots are printed while this Court is considering this case, the ballots should include the name of petitioner Rahm Emanuel as a candidate for Mayor of the City of Chicago.’’
-
Makes sense, though, since if the intermediate court's decision stands his name gets struck and it can't be undone if the decision is reversed later, but if they either refuse the appeal or find against him at the IL Supreme Court, votes for him can always be thrown out later.

You really think that the issue is going to be adjudicated "justly" in Illinois??

No telling, Doc. The IL Supreme Court has a lot more self-respect than Floriduh's, and although the IL State government has issues of its own, it is not part and parcel of the Chicago machine.

True, but it may be more 'on board' the 0dumbo machine than not as courts go these days. Hence the stay ...

Can we say Rahm was "selected" by the Illinois Supreme Court?

Can we say Rahm was "selected" by the Illinois Supreme Court?
I wouldn't go that far quite yet. If they even decide to hear the case (likely), who knows what they'll rule?
BTW, a new poll just out:
While the Illinois Supreme Court prepares to weigh whether Rahm Emanuel's name should appear on the upcoming mayoral ballot, a new poll released Tuesday by the Chicago Retail Merchants Association (CRMA) shows Chicagoans have already made up their minds.
The third We Ask America poll conducted by the CRMA found that an overwhelming majority of Chicagoans think President Obama's former chief of staff should appear on the ballot. Nearly 72 percent of respondents say Emanuel's name should be a choice on the Feb. 22 mayoral ballot while 23 percent say it should not.
Assuming Emanuel's name does appear on the ballot, the poll found Emanuel favored by 52 percent of respondents, an increase of nearly 8 points since the December 20 poll. His closest rival, former school board president Gery Chico, garnered 14.4 percent while former Senator Carol Moseley-Braun received 11 percent. Emanuel's lead of 37.5 points is well outside the poll's margin of error of 2.05 points. About 16 percent of voters were uncertain who they would vote for, nearly unchanged since December.
If however, the court finds that Emanuel should not be included on the ballot, Chico's lead over Braun doubles. The poll found 33 percent of likely voters favored Chico with Braun earning 17 percent. The race would still be very competitive despite Chico's 16 point lead because 38 percent of voters remain undecided.
Miguel Del Valle, William "Dock" Walls and Patricia Van Pelt-Watkins all polled in the single digits in both polls.
The telephone poll of 2,308 likely registered voters was conducted on Monday, January 24.
