The attorneys for Fred Santos say ex-Governor Schwarzenegger violated the family's constitutional rights under Marcy's law.

The voter-approved amendment requires victims of crimes, including family, be notified of parole hearings in advance, so they have a chance to be heard at a hearing.

I don't think so. So I'm not sure this law would apply to the governor granting clemency.

Post by: DumbAss Tanker on January 21, 2011, 08:56:38 AM: Executive pardon powers are normally something entirely separate from parole hearings, they are paper appeals (Or even possible for the executive to self-initiate) and are a plenary, nonreviewable power...UNLESS Californistan has hosed that up too.
