Title: Judge Rejects Health Law Challenge

WASHINGTON — For the second time in two months, a federal judge has upheld the constitutionality of the new health care law, ruling on Tuesday that the requirement that most Americans obtain medical coverage falls within Congress’s authority to regulate interstate commerce.

The judge, Norman K. Moon of Federal District Court, who sits in Lynchburg, Va., issued a 54-page ruling that granted the government’s request to dismiss a lawsuit brought by Liberty University, the private Christian college founded by the Rev. Jerry Falwell. Last month, in a separate case, Judge George C. Steeh of Federal District Court in Detroit also upheld the law.

Like Judge Steeh, Judge Moon was appointed by President Bill Clinton, a Democrat.

Can someone familiar with this clause (as in a Human Resource type person) explain to me why this statement holds true???

We aren't allowed to buy insurance through "interstate" corps are we?  I thought insurers bought by employers were of the local and state variety.

Pinhead activist Judge doesn't know his Constitution. Obamacare violates the Commerce Clause as defined in Article I of the Constitution. Essentially, congress cannot force an individual to buy a good or service. Some people counter that the government forces us to buy auto insurance. Well, that's a state law, not a federal law.

Exactly.

It's a state law in Nevada, but it's not in Wisconsin.  At least not while I was still living there.

The context is also different:  with automobile insurance, the basic reason you are required to buy it is to that if you do damage to someone else, they can be compensated for their losses.

But that is almost the same reasoning that they use for saying everyone must have health insurance.  If someone is sick or hurt and without insurance, then they are a burden on everyone else.

You also only have to buy it to get a driver's license.

This is such bullshit!

First, you don't have to have a car, so the state requirement to buy auto insurance is not about your person, it's about a possession you can to choose to have or not to have.  You also have choices of coverage and can carry only liability if you wish.  Obamacare does not allow you to only carry liability for other people.  Finally, the state can regulate auto insurance so insurers don't get too insane.  Who is going to regulate Obamacare?  Congress?  All of them are on the take from big health insurance companies.  Wellpoint people wrote the damned Senate bill (the Baucus bill) that was shoved down everyone's throat. 

Anyway, this is complete bullshit.  This judge ought to be impeached NOW.  Obamacare forces a mandate on every American from cradle to grave without any protections for the people who are forced to buy the crap.

My daughters pediatrician won't take her cash because the new baby is covered by Medicaid.  The issue is this, she likes the doc but he doesn't take the Medicaid insurer that picked up the baby.  NO ONE does!  A huge waste of taxpayer dollars and her choice of docs was effectively removed.
