How to Legally Stop Paying Credit Cards

You can take steps to legally stop paying your credit cards.

Many people do not realize you can legally stop paying credit cards. There is no longer a debtor's prison to punish those who refuse to pay debts. If you honestly incurred the debt without breaking any laws, you can stop paying it at any time. However, be aware that this will severely damage your credit, may get you sued, and may subject you to collection letters and phone calls. Those who are not working or have little assets to lose are not likely to be sued. There are several steps you can take to legally stop paying credit cards.

Instructions

Use any remaining credit limit on your cards to pay essential bills, such as your rent or mortgage, utility bills, day care or buy food. If you do not intend to file bankruptcy, this is perfectly legal to do. Focus on making sure you and your family stay fed, clothed and sheltered as your first priority.

Due to my mother's dementia, her reaching the donut hole (death hole) she now must pay full prices for her meds ... 453.00 per month plus she's in the middle of lawsuit by my stepbrother for Life Estate..$$$ went to attorney. Credit cards are maxed out I've been looking for ways to help to manage her debts. Called Fast Track Debt Relief.. they figured and offered 357.00 per month. Still too much because Mom's SS is 711.00 per month AFTER Blue Cross/Blue Shield supplement. After meds and fast track debt relief payment she'd have nothing left. I cannot afford to support her and my out of state siblings won't help, I cannot afford to keep on paying for her attorney fee to point of damaging my own credit which I don't want. Doh! I did print out "free drug card", but it won't help as it will only give maybe 20.00 discount on meds. She lives with me and I am her sole caretaker.

I am wondering if we can just stop paying her credit cards, let them go. She has no assets for them to take anything. Her car is 10 years old. She's 81 so it's not like she has to worry about damaging credit report, it's not like she plans to buy a new house!

What a bunch of turds. First, OF COURSE it's legal not to pay your bills - just don't pay them. Just don't whine about the consequences. And don't whine about high interest rates, either.

I call :bs:, if she receives SS and has B/C B/S as a supplement? she gets prescription coverage, and if she's considered indigent some States have programs as far as paying for meds with a low co-pay.

BTW, people "steal" like this all the time on their credit cards, they go out and purchase material items than file bankruptcy, and the people who are paying their bills on time get screwed with higher interest rates. I'm so fed-up with this type of mentality.

BTW, people "steal" like this all the time on their credit cards, they go out and purchase material items than file bankruptcy, and the people who are paying their bills on time get screwed with higher interest rates. I'm so fed-up with this type of mentality.

Remember, congress passed and Lord Zero signed the law that prevents credit card companies from raising rates on those that are poor risks, so the CC companies responded by raising rates on almost everyone before the law took effect.

Actually that does happen.  That damned donut hole is a PITA.  My Mom is on SS and has a BCBS supplement, and pays for Rx coverage.  And as soon as she hits that donut hole, she is on the hook $100s of dollars for her Rx's.  Primarily eye drops, for glaucoma/macular degeneration, so no generics on most of it.

The Donut Hole for Medicare Part D participants starts at 896, and won't pay till they hit catastrophic.  I had to look it up.

Not necessarily true. We're in the process of filing for bankruptcy (for many reasons) and one thing a good lawyer will tell you is to stop using credit cards IMMEDIATELY. If I went out and bought myself a new Louis Vuitton bag on credit two weeks before I filed bankruptcy, the lawyer basically told us that we'd be committing fraud and the courts wouldn't accept our bankruptcy case.

Also keep in mind that when someone files for chapter 7, their assets are liquidated. There is an actual list that states what a person filing chapter 7 may keep, up to x amount of money. In other words, if I went up and racked up thousands of dollars in debt on jewelry and handbags and other non-necessary items, it wouldn't be worth it because it would all just get sold to pay off my creditors.

I'm sure people do scam the system, but many people don't.

(I hate reading stories like this. It really burns me up when people are struggling to pay their bills and do the right thing and you hear scumbag stories like this.) :censored:

Nope.  My broker set my Mom up for a suhweet BCBSTX supplement.  AND she pays Humana for another Rx supplement, the BCBSTX is just for medical.  Medicare part D is the Rx part, and separate than the rest.  It is messed up, that is all.  Mom knows to budget, to save up for the donut hole.  It's a killer.

Oh okay, so I can just stop paying my credit cards?  Nice.  I guess I can just deal with the harassing letters and phone calls from collections.  That's always fun.  Maybe I could make some new friends and we can add each other on Facebook and play Farmville together.

I'm not even going to go to work anymore.  If we don't have to pay the credit card bills, why bother working?  And while I'm at it, I'll stop paying my car loan.  We will just hide our cars from the big bad evil repo man!
