At one time, the Equal Employment Opportunity Commission fulfilled an arguably important role in enforcing anti-discrimination laws against people who really faced unfair discrimination. Now, it appears the EEOC has declared war not just on unreasonable and unjust discrimination, but on all discrimination in hiring — even reasonable choices by employers. I guess that means that Bank of America couldn't refuse to hire someone like Willie Sutton if he were still alive. Next we'll have known pedophiles working at preschools.

Guess I'll tell my employer they can't run drug or background checks on me anymore, and see how long they go until they stop laughing.

Interesting, I don't have the time to check out the EEOC page and verify the thing now, but if it really says refusing to hire based on previous convictions or arrests is illegal discrimination in violation of Title VII of the Civil Rights Act or the lesser-known antidiscrimination laws they are charged with enforcing, they're wrong. Either they'll stuff it down the memory hole in due course, leave it up but never take one of these to court, or they'll get slapped down when a 'Real' Federal court reviews the EEOC Board or Administrative Judge kangaroo-court decision.

Employers can refuse to hire convicts if they want, like everyone else. Also, if they lie about it, that's a huge no-no.

There is no Federal law that clearly prohibits an employer from asking about arrest and conviction records. However, using such records as an absolute measure to prevent an individual from being hired could limit the employment opportunities of some protected groups and thus cannot be used in this way.
