There's an angle you haven't yet heard. What if I told you that Arizona's new illegal immigration law could end up leading more illegal immigrants down a path toward legal citizenship? Sounds crazy, right? Bear with me.
The Arizona Capitol Times has done an excellent bit of reporting on the new immigration law. It has discovered that Arizona's law could result in temporary work visas and permanent citizenship for more illegal immigrants. It all has to do with the process. In the world of federal illegal immigration, there is a little policy known as arrest-and-release. When an illegal immigrant is picked up, ICE conducts background checks to figure out if this person should be deported. But not all people are immediately deported.
That is usually only the case for persons who had been deported previously or criminals with a record. But most end up facing a judge at a deportation hearing. During the proceedings, the illegal immigrants have the chance to petition for relief, or challenge their deportation. They then become eligible for release from ICE detention. But ... they are also provided with proper temporary work documents and even a driver's license!
Now in Arizona, there are only five immigration judges, so you can imagine that there is a backup in the courts. What ends up happening is that these year-long temporary work visas are extended. During that time, many illegal immigrants qualify to apply for permanent residency by filling out a relief form, which is outlined in federal law. The standards, according to the Arizona Capitol Times, are extremely high and include: living in the US for 10 consecutive years, demonstrating "good moral character," a clean criminal background check, and they must establish that their deportation would result in an "exceptional and extremely unusual hardship" to a spouse, parent or child who is a citizen or legal permanent resident. If you pass the smell test, then you become a legal citizen!
So the argument from the Arizona Capitol Times is this: If the Arizona law results in MORE illegal immigrants being apprehended, this will put a greater number of them in front of judges, giving more people a chance to apply for temporary work visas and even permanent citizenship.
