DU LAW & CRIMINAL LAW WHIZ'S-I NEED URGENT ADVICE ON A CASE! PLEASE HELP!!!
To begin I live in the state of Ohio in a very conservative rural county. On October 30, 2009 I was cited for minor consumption by my local OHio police agency. I have not taken so much as a drink since then and even turning 21 in a month I do not plan to drink. To get to the point though...
I plead not guilty to the charge of Underage Consumption. I was appointed a court appointed attorney who not only myself but my family believed he was not representing in my best interest and he was a bad lawyer to me. My Lawyer and I reached a plea agreement with the prosecutor with the stipulations being 60 days in county jail with 57 of the suspended and 3 to serve. Also I was fined $850 and was given the opportunity to work off my fines through a community service program in which the stipulation was that I had 30 days from the date I was sentenced,December 1, 2009, to complete however much community service I did they would deduct $10 an hour off of my fines. Unfortunately just 1 week after my court appearance I was taken in for a major ear surgery, the 4th of my lifetime. Due to this surgery I was advised not to be in outside cold temperatures therefore I could not complete any of the 30 days I had to do the community service which was going $10 an hour to pay off my balance of $850 in fines.
As the begining of the year approached I made several small payment towards my fines totalling somewhere around $200. Then just like many Americans around the country, my father lost his job as well as my mother who eventually took a factory job paying a measely $7.50/hour. The point I am getting at though is that for the first 6 months of the year and the first 6 months of my sentencing, every dollar I made at my job went directly to helping pay my parents rent, and help out with the electric bills, and other items that most would consider the basic essential of life. Believe me I made every effort I could to pinch and squeeze to pay on my fines and pay my fines off. Yet unfortunately after applying for several loans I was declined because I have no credit and the banks are not making 'risky loans' anymore to someone like myself with no real assets.
I just recieved a letter notifying me that I am due to appear in Ohio County Court on May 18,2010 for a probation revocation hearing. Basically meaning that because my financial inability to pay the $850 in fines that I am going to be ordered to serve the 57 days of the terms of my probation as well as the court pays you $50 off your fines for each day you spend in jail. So I am looking at somewhere between 60-80 days in the county jail because I am not rich and have supported my family who has supported me my whole life, I wasn't about to let my parents live on the streets because I had to pay my fines, I have better morals than that.
I tried to fire my court appointed lawyer because he is not working in my best interest and the clerk of courts informed me I could not do that, I am stuck with him.
I am praying that when I go into Court on Tuesday that I can explain to the Judge whom I know on a personal level since i was young, even working on her campaign to be judge because she was a Democrat. The thing that I pray will help her realize it would be counterproductive of the court to put me in jail because of my inability to pay my fines.
I am a full time college student majoring in Criminal Justice and I am on the A-B Honor Roll at my college. I have held a job since I was 14 years old, and I have just recently been hired on at a new job in the city I live in making more money than I ever have and being a productive member of the community paying taxes like everyone else.
Also I have just today won the Presidency of the American Criminal Justice Association Delta Alpha Upsilon Fraternity Chapter, which consist of over 200 members and I am a first quarter student!
I could really use some advice guys even if ur not legal experts I have been beating myself up over this, if I do go to jail I get kicked out of college, lose my presidency, and lost my new job.
Can I ask for a Continuance for a certain amount of time so I can raise the money to pay off the fines before I have to go to court next?
Any Advice would be greatly appreciated!

you f'ed up dummy. the court gave you options to avoid jail (and your cellmate, bubba) but you failed to honor them. now you get to spend time in the slammer, at the taxpayer's expense.
am i missing anything here? or is there some wisdom we can impart on this clueless one.

Invest in Soap on a Rope or KY Jelly. Just a little innuendo folks. BTW Pissing off your lawyer and courting a judge will really help. :uhsure:

That means, DUmmies, that had your boy worked a measley 4 HOURS PER WEEK in paying off his fine, he'd have been done a couple of weeks ago. Had he done 8 hours a week, (like say, on every Saturday), he'd have been done around the middle of February.
Now please don't tell me that the ONLY job that he could have done would have involved outside work, particularly had he had a medical reason not to. Bottom line, he blew it off. His "criminal justice" work is a cover to find ways to skirt the local dope laws and minimize his "lovin time" with Bubba in the state pen, which is doubtless where he's heading.
If you were so Goddammed smart, you would have realized that you were caught, should have done the time, and paid the fine without a bitch or a moan--oh, and how did you get that surgery without insurance, DUmmies?

What's the difference between "Underage Consumption" and a Minor in Possession of Alcohol? I got a couple of MIP's in Texas, and the fines were like $50 or something.

I concur. For a MIP you would get a fine, and maybe some community service, but no jail. Something smells fishy.

First time DUI offenders rarely get jail time, so there is more that the DUmmie isn't telling.

As I said above, even in the somewhat strict county of Tarrant, my MIP's were fines for somewhere in the neighborhood of $50 and no community service.

I don't think this DUmmy has a lot to worry about. Not many defendants get to stand before a judge they have a positive relationship with.

Ear surgery that kept it from being outside for 85 weeks? And how the hell did it get from home to school to work without going outside? I think not! Basically, it had to come up with $10 a week. Wouldn't that just be a couple of babysitting jobs a week? With such excellent grades it could advertise to tutor someone? I made a good bit of pocket change tutoring. If it was a criminal justice major one would think it knows the law.
But just to recap...it got busted for drinking underage...got the worst lawyer in the county...got a sentence of 60 days suspended if it did a measly amount of community service...it had ear surgery which, evidently, didn't keep it from going to school or working but did keep it from doing community service...the ear surgery seemed to have made it impossible to use the phone because it couldn't call the probation office (or whatever) and see if there was some indoor work it could do...both parents lost jobs (Bush's fault)...DUmmie had to pay family bills because of its strong morals...but no credit as it can't get any kind of student loan...or grant...or scholarship...it can't fire its lawyer who didn't get it off scott free...it has a new and very good paying job but still no money to pay fine...it knows the judge personally (having been one of probably a couple dozen phone bank volunteers and offered to put a yard sign up) so it's hoping to use a 5 minute relationship to get a continuance...poor DUmmie...just can't get a break...GLOOM, DESPAIR, AND AGONY ON ME!

I Made A Terrible Mistake This Week & Any Legal Advice or Support Would Be Welcomed!!!!
Let me begin this by introducing myself to those that may not know me. My name is Corey Baker I live in small town Ohio in a hardcore Republican district. I have been a member of DU since early 2003 when I was fairly young rooting for John Kerry in the primaries. Du has come to be a sort of safe haven if you will for me to discuss important issues with very knowledgeable people.
To get on with the subject of my post, This Monday I was sitting at my home and I hear a loud banging at the door. Initially I go to the door to see who it was and what was so urgent. At the door stood my landlord with an Eviction Notice because my parents had unfortunately been devastated by the job losses that they fell behind in rent. Admit tingly, at 20 I still live with my parents, I know, But I work 5 days a week and with their recent job losses they couldn't afford for me to move out as I pay a good portion of the utilities.
With that being said, the agonizing stress of the situation of not knowing where my family would be living after the next week put my anxiety level at an all time high! So I decided to go to a local bar here in my hometown where I would be meeting several of my buddies. In Ohio you only have to be 18 to get in a bar you just can't drink, the point being myself as well as my buddies for the most part where under 21.
To be honest and admit my mistake I must tell you I began drinking. I did not feel intoxicated or impaired enough to limit my mobility skills and reaction speed, so I began to drive home. Well two of my friends that rode with each other from a city about 11 miles away got into an altercation which left one of my buddies walking back to town 11 miles.
As I am usually a generous person I knew that it would be wrong to let him walk that distance so I stopped him and another friend he was with and offered them to stay the night at my house a half mile down the road, they accepted.
En Route to my house I was pulled over by a local police officer. She was a very nice generous female cop. Now you must know I admire law enforcement officers as I am going to school to be one so I was extremely cooperative.
She stepped me out for a field sobriety test in which I consented. I was told to walk the straight line one foot in front of the other. I explained to the officer that I had 3 previous surgeries and that medically told to me my equilibrium was off balance and I would have problems with balance. She had no response to that. After twice in which I did poorly she turned me around put the cuffs on and told me I was under arrest for OWI.Remaining calm I asked the officers what had become of the other two occupants of my vehicle, she explained the had failed Breathalyzers but they weren't driving so the were free to walk away, I was astounded. I cooperatively went to the police station and was wrote citations for the following>>>
*OWI- Breathalyzer registered .101
*Minor Consumption of Alcohol
*Speeding- 45 in a 35
The Judge in the case who Ive dealt with on a prior Minor Consumption 2 years ago is my ex-family lawyer who lobbied for prison time in a case where my Aunt was killed in a drinking and driving accident, and her best friend was the one driving. Believe me this was one of the hardest tragedies I have ever had to face, we were so close and she was taken too soon, and I DO NOT condone drinking and driving I am against it but I also am a realist in a sense of the number of people who do it, and unfortunately in this case I was one of those numbers.
To conclude here I am going to school in the future for Criminal Justice Law Enforcement I am afraid an OWI would pretty much ruin that so when I go to court Tuesday I am going to enter a plea of not guilty and possibly ask for a change in judge due to personal relations. For those familiar with the law or with an otherwise good opinion is it even possible to get the OWI reduced to Reckless Operation or some other charge? I really don't want that on my record at 20. I believe I may be able to get the Minor Consumption reduced too on the basis that out of three minors under the influence she chose to only charge one which was me. To me that don't seem logical to not charge the other to minor persons with minor consumption and just send them walking to wherever they went. The speeding ticket I'll own up to!
Sorry to rant and rave but my stress level is to the peak right now and I would greatly appreciate any sound Legal Advice (doesn't have to be from a lawyer) but I would really like to know the best way to not beat these charges but to get the reduced. I am a first time offender with the exception of the Underage Consumption 2 years ago at my high school graduation party and I complete A.A. and 8 weeks of drug/alcohol testing and classed at a place called the Recovery Center. Out of the entire class I was one among very few who was there everyday willing to learn passed every drug test and graduated on time in a weeks with a positive outlook.
I am really scared to go through this right now and its not what I want on my record trying to become a public servant possibly even in the political world someday. If there is anyone out there who could share with me the best way to handle this case with the ultimate goal being to get the charges reduced please share!!! Also anyone with similar stories and scenarios feel free to share the process!

Odds are since he's a kid he has an IPOD, Computer and Cell Phone, he could've sold all 3 and raised some money, and he could've gotten a 2nd job as a Janitor or even a Security Job to pay off the fine.

Name drop as much as makes you feel better, but there is a several year history of abuse of substances - with those years being under the legal one.
Reread some of your posts - they include excuses such as the doctor told you that your equilibrium is off, you had ear surgery, you were stressed - it's all something or someone else, never your responsibility.

And may I add correctly so. Then too, based on the writing sample provided, it is hard to imagine this person getting an A/B average in any college course save Party Hearty. That sample would barley garner a passing grade on the Massachusetts Common Assessment test necessary to graduate high school (which doesn't require much). :bouncy:

The lazy dumbshit could have taken the initiative to check in after the ear operation and found out if there was any indoor work he could do, like janitorial tasks at the lock-up or PD, instead of waiting for the court to drag him back in for failure to perform when the last grain of sand is tottering on the nozzle in the top of the hourglass, and they would've worked out something.
But, as I say, that would've actually required taking some initiative on your own responsibilities...

As for Corey, I don't believe he even had ear surgery. His parents don't work, or not much anyway, and he works part-time. There would be no health insurance. He would be bitching mightily about his $25K hospital bill. And I don't believe for a second he's in the NG.

As a recruiter, I can tell you that they would have had VERY little sympathy for a kid with multiple underage alcohol-related offenses, and to have ANOTHER one would almost certainly ensure his discharge, assuming he wasn't lying to them as well.

Are these jackanapes so stupid they don't know how to avoid the law? They never heard of keggin' in the "Daniel Boonies"? Geez, these people are stooooopid! If ya get raided, it's pretty easy to get lost quick! In all my highscrool years, I think we had the cops show up twice. The only guys busted were those that were associated with the deposit on the kegs! And everyone chipped in on the fines.

I plead not guilty to the charge of Underage Consumption. I was appointed a court appointed attorney who not only myself but my family believed he was not representing in my best interest and he was a bad lawyer to me. My Lawyer and I reached a plea agreement with the prosecutor with the stipulations being 60 days in county jail with 57 of the suspended and 3 to serve. Also I was fined $850 and was given the opportunity to work off my fines through a community service program in which the stipulation was that I had 30 days from the date I was sentenced,December 1, 2009, to complete however much community service I did they would deduct $10 an hour off of my fines.
Minor caught with alcohol and there is a jail sentence for that? are you seriously kidding me right now?

We have contests with the state troopers once a year as a "community" message, and try and drink each other under the table. Afterwards we take a breathalyzer, heh! I blew a .23 last time drinkin' shots of Red Label with a beer chaser!

Last time & the first time & the ONLY time I drank Southern Comfort (cough syrup) was at a dance at the ripe age of 14 while in Jr. high in 1974. Wanting to be cool, I drank 3/4 of a fifth for future bragging rights. Two hours after my first drink, I found myself in the teacher's parking lot behind the school, lying on my side, blowing the dry heaves against a teacher's car's left rear tire.
I literally had to crawl to the front parking lot of the school to be picked up by my friend's mother for the ride home. Luckily, the parental units were in bed when I got home.
I was sick for three days and NEVER touched SoCo again. Nor will I ever...
I did get some pretty good week long bragging rights out of that ordeal though.
Peer pressure - we ALL know the drill...
