Title: Justice Stevens retiring from Supreme Court

Supreme Court Justice John Paul Stevens, the court's oldest member and leader of its liberal bloc, is retiring. President Barack Obama now has his second high court opening to fill.

Stevens said Friday he will step down when the court finishes its work for the summer in late June or early July. He said he hopes his successor is confirmed "well in advance of the commencement of the court's next term."

Speaking at the White House, Obama praised Stevens for his "independent mind, record of excellence and integrity, [and] fierce dedication to the rule of law." He pledged to move "quickly" to name a replacement with "a similar mind."

I got to follow some of this on MSNBC at work.  Their "short list" has the current Solicitor General or another Appeals Court judge (7th Circuit, I think).

Someone pointed out that Stevens only hired one new clerk.  Poor bastard, how's he supposed to get any work done?  That guy will spend more time looking for a new job than anything else.

Sorry but I am calling bullshit, the Republicans will bitch but thats about it. I would love to see them fight the person he puts up but we all know they wont. Correct me if i am wrong but I dont remember a Dem prez (clinton, carter) pulling a nominee due to the republican fighting them over it.?

Especially when the new court session starts in October, and Lord Zero has a 59-seat tame Senate until January.  The Republicans will kick and scream and launch whatever hystrionics they will, but there is exactly jack shit they can do the prevent a MessiahnFuhrer nominee from being sustained.

This is why the Justice is retiring now - just a week ago, he went on about not deciding to retire yet..

Then he changed his mind quite suddenly.

Somehow, I think team Obama showed him some poll numbers and made the case that "if you delay your retirement, we will have trouble finding a new appointee who shares your ideology."

And out the door he goes.

The Senate Republicans are making noises about fillibustering any radical nominees.  We'll see if it's just hot air.

To the cheese-dick Republicans in the Senate, any nominee that is a rock-ribbed, strict constructionalist, constitutional conservative would be the only type of nominee they might consider "radical".  Comrade Obama's nominees will skate through with nary a raised eyebrow, even if he does nominate Bill Ayers to the bench.

The whole Senate needs a SemTex enema...
