Terrorists who want to overthrow the United States government must now register with South Carolina's Secretary of State and declare their intentions -- or face a $25,000 fine and up to 10 years in prison.

The state's "Subversive Activities Registration Act," passed last year and now officially on the books, states that "every member of a subversive organization, or an organization subject to foreign control, every foreign agent and every person who advocates, teaches, advises or practices the duty, necessity or propriety of controlling, conducting, seizing or overthrowing the government of the United States ... shall register with the Secretary of State."

There's even a $5 filing fee.

By "subversive organization," the law means "every corporation, society, association, camp, group, bund, political party, assembly, body or organization, composed of two or more persons, which directly or indirectly advocates, advises, teaches or practices the duty, necessity or propriety of controlling, conducting, seizing or overthrowing the government of the United States [or] of this State."

It's not like it hasn't been done regardless of court opinion.

The American people violently threw off the yoke of oppression once.

Since overthrowing the Government is a crime under Title 18, it seems to me that this would violate the 5th Amendment. Once registered, a person would be incriminating themselves. Then there's the whole First Amendment thing. However, since South Carolina isn't telling these folks they can't freely associate with a "subversive group", I don't see that one as a violation.

Then the army would have no right to ask if you were a homosexual or ever belonged to a subversive group. Day care centers could never ask if a person were ever convicted of child abuse or sexual assault.

I would also argue that registering is a self-admission. Failure to register wouldn't convict someone of being a subversive but of failing to register.

And the 1st Amendment does NOT protect calling for the violent overthrow of a duly elected government. The 1st Amendment is designed to protect people who would have their free, political voice silenced by those who aould use violence and coercion.

Seems like yesterday when everyone was buying or building their own CB for home and car.   What a mess, that became.   Before the laws changed one had to have a Federal License and call letters----Mine was KGU-7792---California.

This license had a questionare that had dozens of questions, the only one I remember for sure was asking if I had ever belonged to the John Birch Society.

Off to the book case and the encyclopedia and find out who John Birch is or was. 

There were no questions asking if I belonged to the Black Panthers, or was a student at Berkley, took drugs or was gay.  We were then at war but no questions about having Asian relatives. 

Darn cycles and circles never end, what ever happend to the old no one can be forced to testify against themselves with threat or coercion.?

 According to the rules if still in place today, half of Obamas advisers would be ineligible to get as much as a licence to talk to truckers on a road trip.

Vesta, I think that you're a little off topic with your post because it really doesn't address the subversive issue. It does, however, show how some of the military and the military family violates security. If you told anybody of a ship or subs movement/ arrival time, then you, too, are guilty of OPSEC. That said, you aren't alone in doing this as I noticed several publishings in the Norfolk, VA paper of when and where a ship would arrive. IT always boggled my mind as to why the Navy never took any action against publishing the ship's arrivals/ departures. I'm going to split this post and move it to the military section.

Many ships have their own websites that shows pictures of their latest stops and stuff. Obviously they would never give too much info. Not like a site with GPS coordinance of all ships. lol

IIRC the mechanism exists already in the form of holding someone as a material witness.
