And so it begins.
WASHINGTON – A federal judge has tossed out most of the government's evidence against a tarrorism detainee on grounds his confessions were coerced, allegedly by U.S. forces, before he became a prisoner at Guantanamo Bay.
AP on Yahoo news (http://news.yahoo.com/s/ap/20100108/ap_on_go_ot/us_guantanamo_detainee)
I can see more evidence being thrown out for lack of Miranda warnings. This isn't even a high profile case like KSM will be.

It'll get worse.
Imagine what MUST happen for any jihadi captured based on intel obtained during those interrogations that are now inadmissible.
Apparently President Constitutional Scholar never heard of the fruit of the poisoned tree doctrine.
As much as we would like to think our SpecOps could capture sand-rats, waterboard them and then give them a .22 Tylenol behind the left ear to make the headache go away we know that will never happen that way, even when Obambi is replaced in 2013. What that means is:
A) Terrorist is captured and is not interrogated in order to preserve admissibility of any statements.
B) Terrorist is captured and interrogated but only to aid immediate lethal action against a higher target but once the higher target is dead the intel trail ends.
Either way our intel gathering abilities have been knee-capped.

But it's in Massachusetts!

It makes perfect sense, in a civilian court.
Was his miranda rights read to him? Did he have an attorney present at the interrogation?
These are extremely important things in a CIVILIAN court and if the judge did not do them, the judge could be in serious trouble.
Too bad nobody saw this coming. lol.

Too bad nobody in the Obama administration saw this coming. lol.

I think they knew exactly what would happen.

I think they knew exactly what would happen.
And they're getting an inkling of what will happen in November . . .

I try not to ascribe to actual evil that which can be adequately explained by stupidity and hubris.

How could they NOT have known this would happen? It's exactly what every lefty lawyer said they wanted to give to the hajjis. The lefties want hajjis to get off in court because they believe America in general and Bush in particular are/were evil. Getting the hajjis off on technicalities would embarrass Bush and embolden people who would humble the US and make us abandon Israel.
You don't seriously think the Lawyers Guild could sincerely find constitutional rights for foreign hajjis that it seeks to deny to US-born christians do you?

Take a drink of water, MSB. The Lawyers' Guild is not the DOJ or Eric Holder, Barry Zero, or any other one person. The frickin' ABA even came out supporting civilian trial (With which I heartily disagree, and they did it for motives of their own which do have something with trying to suck up to the current administration but have a lot more to do with institutional issues with being dead-set against military commissions).
Only a completely arrogant idiot (This is where the stupidity and hubris comes in), not an evil genius, would think that he could take over DOJ and go off in a completely new direction on these cases, end up getting a totally unsatisfactory decision in court three years [My estimate of both time and result] after taking over, and that none of the bad stuff would stick to him, but all be blamed on the prior administration.

I would like to believe you but we have the case of the New Black Panther Party, the firing of IG Gerald Walpin.
My Dog, the man hired a pederast as safe school czar!
The lefties want these case thrown on technicalities.
