Title: FT. HOOD Hasan's attorney claims civil rights violation

FORT HOOD - The lead defense attorney for accused Fort Hood shooter Maj. Malik Nidal Hasan says he will file a motion complaining his client's civil rights are being violated.

Belton attorney John Galligan told News Channel 25 via phone the restrictions the military has put on his client while he's confined to his room at Brooke Army Medical Center in San Antonio are illegal.

Hasan is restricted to speaking English only, and the only visitors he can have are his immediate family, and his legal counsel.  "But his attorneys and his family can't be in the room with him at the same time," Galligan complained.

Galligan was upset that his client was praying on the phone with his brother
Friday in Arabic when he said the military interrupted the call.

"I'm going to file a motion when I get back to town saying that's a violation of his civil rights, " Galligan by phone from San Diego.  "I've never seen this from the military."

Unless I'm mistaken, the usual civil liberties and rights are not applicable under military jurisdiction.  They should have pulled the plug on this a**hole when they had the chance.

True. Civilian  law and Military law are different. The lawyer's just grandstanding. We should expect to see it get even worse. And just wait till KSM goes to NYC for his trial.  :banghead:

He is in pretrial confinement.  There is nothing wrong with limiting his visitors, not allowing the lawyer and family in at the same time, or restricting his outside communications.  There really shouldn't be a problem with him praying in Arabic as I believe Islam requires - but by himself.  His religious observance does not have to have live participation with anyone else to be properly observant.

Be effin lucky he's able to do what he is doing right now.

YOu better study up on UCMJ a little more before you start waiving your ACLU touchy feely credentials.

YOu better study up on UCMJ a little more before you start waiving your ACLU touchy feely credentials.

Wasn't this guy supposed to be a former military lawyer?  If so he should know how things work and is just doing this for publicity.

Actually I met him back in the day when he was on active duty, he is a retired JAG Colonel and no dummie by any means.  At the time he was the O6 SJA at USARSO, when it was still in Panama, and included an independent infantry brigade, before it moved out and became a purely HQ command.  I wouldn't jump to any conclusions about him not knowing about the military or the UCMJ just because he is advocating for his client and pissing people off.

IMHO that makes it even worse that he's on the case if he's a former SJA.

In an unrelated note...I was on orders once a long time ago to go to SCN at Ft. Clayton Panama.  Way back when General McCaffrey and CSM Thomas were running the show down there.
