A Franklin couple is seeking $200,000 in damages from a Quincy Dunkin’ Donuts and its insurer, claiming their toddler burned his neck on a “dangerously hot” hash brown patty served at a drive-through.

In a civil suit filed last month, the parents of Cullen MacLeod, 23 months, claim their son suffered “serious and permanent burn injuries” after the hot hash brown fell from his mouth and onto his neck, where it immediately stuck.

“It took only seconds for the extremely high temperature of the interior portion of the food item to severely burn and blister (Cullen’s) skin,” attorney Joseph K. Curran Jr. wrote in a complaint filed in Norfolk Superior Court.

Before handing the hash brown to her son to eat, the boy’s mother, Robin, checked it and found it was “lukewarm,” the suit states. The family claims the hash brown heated up “unevenly” and that the food’s interior temperature was “unsafe for public consumption.”

I don't care if mom claims to have checked the hash brown, she failed in her job as a parent. IMHO

I think this is just a shakedown - those hash browns had to have been handled by at least a couple of people before the mom handed it to the kid. I don't see how it could've burned and scarred a toddler forever. Kids that young heal almost instantly.

I also found it strange that a mom would give an 18 month old hash browns while the child isn't sitting upright. How else would food fall from the mouth and land on the neck.  It's hard to chew food while lying down.

Off topic but....Dunkin Donuts is not what it used to be....their donuts are tasteless and usually stale.

I prefer to buy Krispy Kreme, or even Walmart's fresh donuts.

Off topic but....Dunkin Donuts is not what it used to be....their donuts are tasteless and usually stale.


They're usually made at large regional plants and delivered to the store now, as opposed to "It's time to make the doughnuts."

Um, most liberals I know are all for tort reform.  Cases like this are BS.  The majority of malpractice suits are BS and are to blame for a lot of the costs associated with health care.  I'd like to see a fine for people wasting the courts time like these people are.

Good luck getting that past the moonbat Trial Lawyers' Association that donates heavily to the Dim-o-crat Party so that they can keep their shakedown system operational.

We still have one in Spokane that makes theirs every morning. Whenever I'm in town I wait until they make the cake donuts with the orange icing.

You've obviously never had kids...  My son could be hanging upside down while he ate, and he'd still get food stuck in his neck.
