RENO, Nev. — A woman has filed a lawsuit accusing Pittsburgh Steelers quarterback Ben Roethlisberger of raping her last summer in his penthouse hotel room at a casino in Lake Tahoe during a celebrity golf tournament.
Roethlisberger's lawyer adamantly denied the allegations Tuesday, and was quick to point out that the woman never went to the authorities.
"Ben has never sexually assaulted anyone. The timing of the lawsuit and the absence of a criminal complaint and a criminal investigation are the most compelling evidence of the absence of any criminal conduct," David Cornwell said in a statement. "If an investigation is commenced, Ben will cooperate fully and Ben will be fully exonerated."
Cornwell did not immediately reply to a phone message and e-mail seeking more comment.
The suit seeks at least $440,000 in damages from the quarterback and also alleges hotel officials for Harrah's Lake Tahoe went to great lengths to cover up the incident. She's seeking $50,000 in damages from the Harrah's officials.
The woman's lawsuit says she didn't file a criminal complaint because she feared Harrah's would side with Roethlisberger and she would be fired.

Sorry, lurker, but reporting it to hotel security and "they covered it up"? No report to the police? No rape kit? No record of any kind of counseling of any kind between then and now?

A year after it happened there will be no evidence to prove the issue either way, unless the hotel cameras were lucky enough to catch something on tape. The fact that she wants $500,000 in damages makes me very suspicious, especially considering that there doesn't seem to be any physical evidence to support her claim. I hate to doubt a woman who makes such a serious accusation, but "he said/she said" cases are nasty, no matter what the court decides in the end, there will always be some who believe that he is guilty.

And sorry, having been to Vegas a number of times, even if you have a "personal" Casino Host, just because your television doesn't work means THEY are going to go in and fix it. That's what they have Maintenance Services for, and that's who should have been used/called.

We were sued a few years ago because the fireworks at our July 4 party led a woman to have nightmares 2 years later. (Hey, I wish they were that good!). Frivilous, you betcha, but our insurance company settled with them to make her and her snakeoil attorney go away.
I don't believe a major hotel like Harrah's would cover up a crime. If so, they deserve to lose business and fold. That's what she's accusing them of doing too. I wouldn't stay there.

First of all I found her attorney, Calvin R.X. Dunlap, on Google, which led me to his website which had nothing much. I DID NOT find him on any of the Reno Attorney/Lawyer listings or major Legal Directories for Nevada. Not even the Yellow Pages? Hmmmm?

Sorry dear, but I think you're off base on this one. IF she were in fact a rape victim, and being PHYSICALLY assaulted (as she stated in the complaint) by as she states, "a 240-pound man" should have left SOME sort of mark. She also stated he ejaculated on her. No DNA, ANYWHERE? Really?
And notwithstanding, Harrah's is a multi-billion dollar corporation. Ben is an athlete accused of a crime. Why would Harrah's risk the liability to bring someone like that back if there was ANYTHING behind it at all? Would their employees all act this way, each and every one of them fully aware of what could happen to their own careers and the company if it got out that you can just rape employees at will and get away with it cause they'll cover for you?
In this case, the "big guns" smell money. And as much as I hate to be a cynic as much as the next guy, but I am one these days, particularly when it comes to scheming women and lawyers. I've seen too many ambulance chasers in my time to think these guys (and this woman's) motives are purely altruistic.

You are basing your comments on a complaint, which is step 1 in a long process. This isn't a raped-while-walking-to-my-car incident. Lots of layers here. Could end up being a mentally disturbed individual fabricating more into a quick sex thing, but these lawyers are not stupid. They got something.

Having worked for and on the other side of personal injury attorneys I know an ambulance chaser when I see one.

This case was taken on by a respected high profile law firm. What has been released to the press makes you scratch your head over why a law firm would take this on, however the complaint itself was rather well written and made me pause in passing judgement on whether it happened or not.
Now comes this affidavit, which predictably (and clearly the intent of the filing) lays some foundation that the sex actually happened. The lack of physical evidence (necessary for criminal proceedings) is really no longer an issue. Roethlisberger's case just took a twist, and is now a lot more difficult to defend.
I suggest that instead of making ANY judgements at all in this case that you sit back and watch it unfold. McNulty has a damn good legal team. As I stated in the beginning, this is worth watching.

IMHO...Ben wanted a booty call...she thought that if she slept with him he'd want to see her again.
He never called back....she got pissed. Lawsuit insued.
Remember the William Kennedy Smith rape trial? All that drama just because he called her by another girls name just as they were about to get busy on the beach.

If I were on the jury with just what we have here I would go for the defence.
The woman involved here is not some 21 year old girl right out of college. She must have been around Casinos all her life.
She was what 30 some odd years old when she was hired at the Hotel and in less then 2 years worked herself into one heck of a good job. A very fast learner and most capable of doing her job with skill.
The Casino business has few ministers of God running them or working there. Small sin city's there.
I have to go with Sparky on this one, it is not easy keeping dirty pool a secret in any kind of organization, gossip goes around like wheels on the slot machines.
One may when they are young think they can sleep to the top but Lord this was a woman who had been around the MOB for 2 years at that place and not a young girl.
How many people were she responsible for on that VIP floor ?
You know, all this was suppose to have happend at 10 O'clock at night, this is a place where people are coming to their rooms off and on until day light needing room service, more towels, perhaps some hangover cure, a hooker or drugs.
I cannot get over the fact that she left her station to go to his room for any reason.!!!!!
I am not convinced she had NO backup for breaks or bathroom. I am not convinced she could not have called for a back up, told them where she would be so as to not left the station deserted for even one minute.
She was in charge of being at the beck and call of all the high profilers on that floor, the customers were not in the cheap $400.00 a night rooms, they were in suites and drunk or sober expected service at the instant they demanded it.
Now if all this happend as she says, she may have been spooked big time and acted in a hysterical manor, but next day at the least is when she would have to decide what to do, go to the police or suck it up and learn a good lesson.
What did she think running around work telling everyone she had been raped was going to accomplish.? If she herself didn't go to the police what did she expect her boss to do about her problem.?
There is no evidence that man did one darn thing to her, it is all she said. No evidence he had a hooker in his room before he jumped on her, just her word. One full year after the fact and she never to this day has put out a criminal complaint on him.
At this point I find the defendant NOT GUILTY----with more information coming our way, I may revise my thinking.

RENO, Nev. (AP) - A former Harrah’s employee has filed a motion to dismiss a lawsuit that accuses Pittsburgh Steelers quarterback Ben Roethlisberger of raping another worker.
Stacy Dingman is the former director of hotels at Harrah’s and one of nine defendants named in the lawsuit filed last month in Washoe County District Court. The suit also accuses managers of the hotel-casino at Lake Tahoe of covering up the alleged sex assault.
She also said she is the former best friend of the woman who claims Roethlisberger raped her at the hotel-casino during an annual celebrity golf tournament in July 2008.
Dingman said in her motion that the lawsuit is baseless and that she has been dragged into it without justification.
