DOJ Files Motion to Drop Case Against Ex-Sen. Ted Stevens

The U.S. Justice Department has asked the federal court to dismiss its case Wednesday against former Alaska Sen. Ted Stevens, who was convicted of seven counts of corruption.

Justice Department sources told FOX News that U.S. Attorney General Eric Holder decided to abandon the case due to prosecutorial misconduct.

The judge in the case has repeatedly delayed sentencing, and at one point held prosecutors in contempt. Justice Department officials later replaced the trial team, but Holder reportedly decided Tuesday to dismiss the original indictment rather than proceed to more hearings that might embarrass the department.

In addition to Stevens' age -- he's 85 -- and the fact he no longer is in the Senate, losing his seat last November to Anchorage mayor Mark Begich, sources told NPR that Holder wants to send a strong message to prosecutors that misconduct will not be tolerated

Stevens was convicted last year of lying on a Senate disclosure form to hide $250,000 in gifts he received from an oil company executive and friends.

Only after the conviction did allegations of FBI misconduct come to light. Stevens sought to dismiss the charges, and the Justice Department's action Wednesday in effect supports Stevens' request.

"Given what has happened in this case, it's not surprising" that charges against Stevens are being dropped, a source close to the case told FOX News.

Will there be any investigation into the "prosecutorial misconduct"?  Not bloody likely. This case served it's purpose of helping to elect a Dim senator, and as fodder for the general election.

It was a political witch hunt just like the one done on Tom DeLay.

Anyone hear about Sarah Palin's legal fees from having to fight those politically charged accusations by dems and libs?  She owes $500,000.

Bill O'Reilly mentioned something about a legal defense fund.  All she needs is 500 people to send in $1,000 each>  He intends to send to her $1,000 to help her pay those legal fees.

It's just sad that the lie about the "Republican culture of corruption" has tumbled like a house built of cards...and the MSM is successfully hiding the fact, while simultaneously finding ways to excuse the Democratic Culture of Tax Cheating.

MSM has lost all credibility to present news in an un-biased way...hell it sounds stupid just typing it...MSM and non-bias...the oxymoron of the decade.

Maybe Alaska should scream like a democrat and demand a do-over....you know, a recall vote and a special election to elect a new senator.

Yeah, I remember a "news" story awhile back when this broke refering to Geither having a tax "glitch." WTF, a glitch! It's outright tax evasion and fraud! The MSN proves its possible to spin just about anything by twisting a few words around. If this was a Republican administration they would be shreiking about it 24/7

I can't stand to watch anything from the media anymore. Michelle Obama wearing a potato sack and it's nonstop fawning about her sense of style and fashion.

Stevens was as guilty as sin, and now he will get away Scot free. Just because he has a (R) after his name does not change anything. As for the prosecutors, they are a disgrace.

I agree and besides 8 terms is way to many. Down with the career politicians.

Maybe he was...but I listened to some of the coverage on public radio, and even they were talking about the dirty stuff the prosecution pulled, and how the judge excused the jury and then reprimanded the prosecutors.   If he was all that guilty, then why'd they pull all that crap?  Why not just nail him honestly?

I have to agree with you MrsSmith.

Regardless of his political affiliations, if he did break the law and then was more or less let go because of prosecutors dirty tricks, then the taxpayers and society are the ones that lose.
If he broke the law and this can be proven WITHOUT political driven shenanigans, then he should be prosecuted and judged according to the law..

Amen.  Stevens is a classic example of someone who, regardless of political affiliation, had long since forgotten he was a public SERVANT.  Eff 'em.  He needs to go as badly as all the RINOs.
