Experts predict Calif. justices will uphold Prop 8
18,000 same-sex marriages already performed seen as safe
Friday, Mar 13, 2009 | Chris Johnson | COMMENTS
Legal experts who once hoped the California Supreme Court would overturn Proposition 8 now expect justices to uphold the measure.
Justices heard oral arguments March 5 over the constitutionality of Prop 8 — an amendment that ended same-sex marriage in California — and whether the 18,000 same-sex marriages performed in the state are still valid.
Gay activists and attorneys from some California municipalities argued the court should invalidate Prop 8 because it is not an “amendment” but rather a “revision” to
the state’s constitution, thereby requiring a two-thirds vote from both chambers of the California Legislature for approval.

Experts who watched the hearing said afterward that justices telegraphed in their line of questioning that they favored upholding the amendment.

6. Enh. It was always a long shot.
They'll have to fix it by way of another amendment.
And while you're at it, California: 50% plus one is a stupid-ass way to amend your constitution. You might want to fix that.
It's only good if you get your 'law' past.

Why do people have such a hard time understanding that constitutional amendments passed by the people are, by definition, constitutional?

Why do people have such a hard time understanding that constitutional amendments passed by the people are, by definition, constitutional?
because if it doesn't do what they want, then it's 'unconstitutional'.

But still I am surprised THAT court would find the state Constitution to be Constitutional

How the heck would saying two homos are "married" change this, P-boi? Are you planning to have children right away? Is your poopshute harboring a uterus? After you give birth through your peehole will you then want to pay school taxes?
No, you shouldn't be "exempt". You are just a homosexual. That means you are not special in any way. You are a citizen who doesn't want to have sexual relations with the opposite sex. This oddity doesn't make you a protected class. This oddity doesn't mean you are being denied a "right". It just means you have no want or reason to get married as defined by society and law. You still have the "right" to get married, just like every other American adult.
