A federal jury on Tuesday afternoon ruled that an Arizona rancher did not violate the civil rights of 16 Mexican nationals he detained at gunpoint after they had snuck illegally into the United States in 2004, but the jury awarded $78,000 in actual and punitive damages to six of the illegal immigrants on claims of assault and infliction of emotional distress.
After a nine-day trial, the eight-person jury -- four men and four women -- returned the verdict in U.S. District Court in Tucson, Ariz., after a day and a half of deliberation, also tossing charges of false imprisonment, battery and conspiracy against Douglas, Ariz., rancher Roger Barnett. Most of the award, about $60,000, was for punitive damages.
Mr. Barnett's attorney, David T. Hardy of Tucson, described the decision as an "80 percent victory," adding that he wished he and his client "would have gotten the other 20 percent." But he said he would appeal the decision, citing what he called "solid grounds." He also said U.S. District Judge John M. Roll had been "scrupulously fair" during the landmark trial.
Mr. Barnett owns the Cross Rail Ranch near Douglas, Ariz., where he maintains cattle on 22,000 acres of private and leased land. A $32 million lawsuit, brought by the Mexican American Legal Defense and Education Fund (MALDEF), sought damages for civil rights violations and the infliction of emotional distress. It also accuses Mr. Barnett of assault, battery and false imprisonment.

78,000? That's some bullshit! :censored:
-
Well, that is it, then. We've just opened our borders to the illegals. No one will try to stop them now.
-
Somebody has to pay the attorneys. It sure as hell ain't coming from the illegals or from MALDEF.
I think it's ludicrous that this court case took five YEARS to try. And it still isn't over because of the appeal.
Kinda wonderin' if Barnett's gonna counter-sue MALDEF just for harassment and bullshit allegations.

Me thinks it just puts an end to the foolish policy of "detaining" illegals caught on your property.
I kinda like the liberating feel that declaring open season on them, and then using a bobcat to dump the bodies back on the side of the border to which they belong, brings.
-
How does someone who is in this country illegally, trespassing, vandalizing property, etc even have STANDING to bring forth a lawsuit?? It's a good thing for the illegals that this didn't happen in Texas. Texas property owners can defend their property with lethal force. Hell, all one has to do is ask the neighbor or a friend to "watch over their property" and those people are jutsified in the use of lethal force.

I can tell you how I feel about this. Same with the terrorists in Gitmo. Eventually there will be no prisioners, they will have all been killed in self defense buy a good samaritan.
That is what the stupid courts and liberals are pushing society toward.
If anyone has taken a concealed weapons course the magic words are "I thought I was going to die". Hey there was twelve of them and they were coming at me, a couple of them had clubs and one pointed something at me and I thought it was a gun......."I thought I was going to die!".

should never have gone to trial

should never have gone to trial
I agree with that about going to trial. What probably happened is like ACORN and the ACLU, the illegals legal fees probably got paid by OUR government.

I have no doubt about that

Did anyone actually see why he had to fork over the cash? He attacked a number of those people. Kicked a woman several times while she was on the ground, made his dog attack some of them.
So I'd say paying up for that is completely justified.

Which may have been within his rights. But he didn't. He held them at gun point and then assualted them for a time. If I catch someone breaking into my house and hold them at gun point while the police come, that doesn't give me the right to beat him with impunity.

He should have made them clean the ranch up at gunpoint then =o)

Yeah. Good news, bad news. Hopefully he can contest the fine and win.

No. You beat the cr*p out of them first, then call the police. :-)
