FORT LAUDERDALE, Fla. – The jury that decided a 40-year chain-smoker was helplessly addicted to nicotine must now decide whether tobacco giant Philip Morris owes his family potentially millions of dollars for his death from lung cancer.
The next phase of the closely-watched lawsuit filed by the man's widow, Elaine Hess, starts Friday in Broward County Circuit Court. Hess' lawyers plan to argue that Stuart Hess became hooked on cigarettes because of deceptive practices by Philip Morris that hid the dangers of smoking.
"The jury's going to hear a lot more about what the tobacco industry has been doing for the last several decades," said Adam Trop, one of Hess' attorneys.
The lawsuit is the first of about 8,000 such cases to go to trial since the Florida Supreme Court in 2006 threw out a $145 billion jury award in a class-action lawsuit on behalf of thousands of smokers and their
So wait...warning labels have been on since before this guy took up smoking(they started in 1965) and he chose to start smoking in 1969--let's say '67 in case this has been going on for a couple of years(the case). Surely, in those days, there was much ballyhoo about labeling being started on the health hazards related to cigarette smoking...yet, he chose to start smoking and now his family sits with their hands extended for some award because he continued DESPITE initial warnings BEFORE he was addicted and during his build up to addiction to nicotine?? What a bunch of balogna!

There more mitigating circumstance is that it has been proven that the tobacco industries have added chemicals to their tobacco products in order to make them MORE addictive. This has changed since that man started smoking. I forget the specific timelines, but the tobacco industries have been ever increasing the addictive chemicals, making it increasingly difficult to quit smoking. Too bad that there aren't good smokes out there that are pure tobacco that haven't been laced with chemicals.

Mebbe so, Hammer-man, but picking up the habit to begin with is a choice made by the smoker.
I don't know of any smoker who enjoyed the taste of tobacco - I know I didn't when I smoked (and quit 30 years ago) - right from the start.
It takes a willful decision to not only pick up the pack and light up, but to continue doing until the point that the additional chemicals you're talking about take hold.
One is not instantly addicted to cigarettes. It's an acquired habit and addiction.
