A federal judge is finished playing chicken with three Vermont convicts upset about a bad meal in prison.
William Sessions III, chief judge at U.S. District Court in Burlington, on Monday dismissed a lawsuit three convicted criminals had filed against ConAgra Foods Inc. alleging they became sick, physically and emotionally, after inadvertently eating poultry entrails.
Christopher Butts, 52, of Dayville, Conn., who served time for driving while intoxicated with death resulting, alleged he bit into a reheated piece of frozen chicken in November 2005 and felt a pus-like substance squirt into his mouth, then saw what appeared to be the animal's digestive tract in the chunk of meat. He fell ill, vomited, convulsed and no longer enjoys chicken, according to court papers.
Two other inmates -- double-murderer Henry "Hank" Butson, 60, and Corydon Cochran, 50, of Cabot, imprisoned for drunken driving and other charges -- also ate poultry pieces from Butts' box. No part of their meal contained foul fowl, but they suffered emotional harm on learning how close they came to the digestive distress their fellow inmate suffered, according to court papers.
