Arraignment Set for Cheney, Gonzales in Prisoner Abuse Case

RAYMONDVILLE, Texas — A Texas judge has set an arraignment for Vice President Dick Cheney, former Attorney General Alberto Gonzales and other officials accused of involvement in prisoner abuse.
Presiding Judge Manuel Banales said Wednesday he will allow them to waive arraignment or have attorneys present rather than appear in person Friday.
Banales also said he would issue summonses, not warrants. That allows them to avoid arrest and the need to post bond.
Willacy County District Attorney Juan Guerra accuses Cheney, Gonzales, a state senator and others of involvement in prisoner abuse at a federal detention center in south Texas.
Defense attorney Tony Canales accuses Guerra of "prosecutorial vindictiveness" and not following procedure.

This is absurd. Only in America do the lawyers get to "play" with the system. A complete waste of our money and time. Guerra and his family should be tarred and feathered. As a former Assistant District Attorney from the neighboring county I can tell you this guy is a loon. He dismisses all sorts of cases and in return signs up his defendants to vote. He is a part of an all Democratic feud in Willacy county where State District Court Judges have been trying to get him removed, and now as the article fails to report he is attacking the State District Court Judge and former Democratic appointed US Attorney. He is not doing this to "see that justice is done" as his job requires, rather he is doing this for his own political motives and for the purpose of retribution. For years he has been re-elected by the voters of Willacy County for reasons that no one in the surrounding counties can surmise. This is the last desperate act of a man who has been finally removed from office. Guerra said the judge was wrong to allow motions to quash the indictments to be heard before the defendants were arraigned.
Banales called a recess so he could try to contact the chief justice of the state Supreme Court for suggestions on how to proceed, and ordered Guerra, who had slipped out once during the hearing, to remain in the courthouse.
Guerra first said "I will not obey that order," but then agreed to stay if the judge asked him respectfully.

What a farce! This case will get dropped. I mean why Cheney. I believe Judge Manuel Banales got into some legal trouble of his own.

Cheney, Gonzalez Indictments Dismissed in Texas Prison Case
RAYMONDVILLE, Texas -- A judge dismissed indictments against Vice President Dick Cheney and former Attorney General Alberto Gonzales on Monday and told the south Texas prosecutor who brought the case to exercise caution as his term in office ends.
Willacy County District Attorney Juan Angel Guerra had accused Cheney and the other defendants of responsibility for prisoner abuse. The judge's order ended two weeks of sometimes-bizarre court proceedings.
Guerra is leaving office at the end of the month after soundly losing in his March primary election.
"I suggest on behalf of the law that you not present any cases to the grand jury involving these defendants," Administrative Judge Manuel Banales said in court while ruling that eight indictments against Cheney, Gonzales and others were invalid.
He also set a Dec. 10 hearing on whether to disqualify Guerra from those cases.
Even in thorough defeat, Guerra saw the outcome as confirmation of the very conspiracy he had pursued. "I expected it," he said. "The system is going to protect itself."
Banales withheld judgment on whether probable cause existed for the Cheney and Gonzales indictments because they were not represented in court and did not present any argument. For the other defendants, he found no probable cause to support the charges.

Actually, with Obama as president-elect, the use of coal has been outlawed--environmental impact and all that. They're now getting a stale Chee-to.
