WASHINGTON -- President-elect Barack Obama's advisers are quietly crafting a proposal to ship dozens, if not hundreds, of imprisoned terrorism suspects to the United States to face criminal trials, a plan that would make good on his promise to close the Guantanamo Bay prison but could require creation of a controversial new system of justice.

During his campaign, Obama described Guantanamo as a "sad chapter in American history" and has said generally that the U.S. legal system is equipped to handle the detainees. But he has offered few details on what he planned to do once the facility is closed.

Under plans being put together in Obama's camp, some detainees would be released and many others would be prosecuted in U.S. criminal courts.

Expect SOCOM to capture, field interrogate and kill lots of hadjis then report them as killed during the raid.

SOCOM is too good at their job and I doubt they will allow something as tricial as BHO get in their way.

naive and dangerous.  the laws of discovery will imperil our intelligence sources and methods.  this is an overwhelmingly bad idea.  obama should concern himself with the curtains for a few months until he is qualified to actually do something.

A third group of detainees — the ones whose cases are most entangled in highly classified information — might have to go before a new court designed especially to handle sensitive national security cases, according to advisers and Democrats involved in the talks. The move would be a sharp deviation from the Bush administration, which established military tribunals to prosecute detainees at the Navy base in Cuba and strongly opposes bringing prisoners to the United States. Obama's Republican challenger, John McCain, had also pledged to close Guantanamo. But McCain opposed criminal trials, saying the Bush administration's tribunals should continue on U.S. soil.

Why don't we just send a gift wrapped invitation on White House stationary to al Qaeda for them to start bombings in this country?

Considering the fact that CAIR will hire every Johnny Cochran type of lawyer available in this country they'll get off with an apology from the U.S. Govt.

Not to mention the fact that these trials will have confessions garnered via military interrogation tossed...under cover operators for the CIA and Spec Ops will be forced to appear open court.

Soldiers and Marines that are involved in any way shape or form with the arrest of any suspect captured on the battlefield will be required to appear in court.

And as soon as one of them can't because they are on deployment...the cae will get tossed and that terrorist will free on the streets of the US.

It took 5 years to establish the current military tribunal system. That means:

A) Obama takes several more years developing a new system.

Suspects languish.

Justice is delayed.

He sets the precedent that no precedent is ever set.

B) He keeps the current system on US soil

But it becomes vulnerable to the courts, essentially creating 2 seperate justice systems on US soil

C) He grants them full civil trial rights.

No Miranda rights were ever read to these thugs

No raid was ever conducted under the auspices of the 4th amendment

Wiretaps et al become inadmissable/compromising

Field interrogations become inadmissable

They can be released for lack of speedy trial

Reasonable bail must be set
