Chambers' may appeal after his suit against God is tossed out
You can't sue God if you can't serve the papers on him, a Douglas County District Court judge has ruled in Omaha.
Judge Marlon Polk threw out Nebraska Sen. Ernie Chambers' lawsuit against the Almighty, saying there was no evidence that the defendant had been served. What's more, Polk found "there can never be service effectuated on the named defendant."
Chambers had sued God in September 2007, seeking a permanent injunction to prevent God from committing acts of violence such as earthquakes and tornadoes.
The senator said today that he is considering an appeal of Polk's ruling.

"If God is omnipresent," Chambers said in that August hearing, "then he is here in Douglas County and in this courtroom."
Polk was not persuaded.

"If" followed by a forensically unprovable statement is not a real sound basis for a jurisdictional argument.

JUDGE: You have not sufficiently shown me that God is responsible for earthquakes and tornadoes.
CHAMBERS: He created the weather systems and geological phenomenon. It says so in His own book.
JUDGE: But those phenomenon are also beneficial.
CHAMBERS: But sometimes they kill people.
JUDGE: Everybody dies even if a tornado or earthquake never occurs in their vicinity in their lifetime. You can't sue God for the inevitability of death.
CHAMBERS: Nonsense, we sue people for wrongful death all the time.
JUDGE: Who says being killed by an act of God is a wrongful death? You're claiming omniscience for yourself by deciding what is right and wrong and that God is wrong.
Are you claiming to be superior to God?
CHAMBERS: Maybe I am.
JUDGE: Then you stop the tornadoes and earthquakes or I'll hold you liable.
Case dismissed.

JUDGE: Nice try, Homer. I believe the book to which you refer was written by third parties claiming to speak for the opposing party, a proposition which does not seem susceptible of objective proof at this late date, but which certainly moves that particular bit of written hearsay entirely out of the realm of an admission against interest or any other exception which would allow its admission, were I to allow this cause to come to trial. Nor, for that matter, is it the only tome which asserts such a claim, and thus I can hardly view any assertion of its authorship on your part as undisputed.
Case dismissed.
