Former GOP Lawmakers Cry Foul About Felony Assault Charges Against Democrat Politician

Democrats pounced after the Justice Department announced felony charges against Rep. LaMonica McIver (D-NJ), claiming that it was motivated by politics. But, apparently, it is not only Democrats who are upset about the charges.
Rep. McIver is facing two counts of assaulting, resisting, and impeding law enforcement officers during a May 9 fracas outside the Delaney Hall ICE detention facility in Newark, New Jersey. Protesters demonstrating against the Trump administration’s immigration policies clashed with police officers outside the building.
The criminal complaint alleges that the lawmaker was part of a human shield trying to prevent the authorities from getting to Newark Mayor Ras Baraka, who was also part of the protest. McIver allegedly “slammed her forearm” into one of the officers, according to the complaint, which also claims she “reached out and tried to restrain” the officer by “forcibly grabbing him.”
In a statement provided to USA Today, 11 former GOP members of Congress condemned the charges against McIver.
They are Republicans who are no better than Democrats.

Mickey Edwards of Oklahoma, Barbara Comstock of Virginia, David Emery of Maine, Wayne Gilchrest of Maryland, Christopher Shays of Connecticut, Peter Smith of Vermont, David Trott of Michigan, Joe Walsh of Illinois, Denver Riggleman of Virginia and former Republican Sen. Gordon Humphrey of New Hampshire.

Their whole framing of the issue is misleading and misses the point. There's congressional oversight, and there's criminal behavior. If the accused are guilty of the latter, then there's nothing for these uniparty Republicans to argue about.

A judge handed down a humiliating decision for Rep. LaMonica McIver (D-NJ) over her antics at Delaney Hall in May 2025: you are not special. The location, an ICE detention facility in Newark, has been the site of numerous civil disturbances as leftists have tried to disrupt and outright storm the building. McIver tried to do that, leading to her assaulting federal immigration officers. Feelings are not evidence, facts, or legal shields, lady. McIver was slapped with a three-count indictment relating to assaulting federal agents (via Roll Call):
A federal appeals court ruled Wednesday that New Jersey Democratic Rep. LaMonica McIver is not immune from prosecution over a tense incident that unfolded outside an immigration detention center last year.
The three-judge panel declined to toss out assault charges against her, even as McIver argued her arrest interfered with her legislative duties.
