And then Biden could nominate someone else for Breyer's seat?

3. Something like that already happened when Roberts was nominated to replace O'Connor.
Roberts was nominated to replace O'Connor but then Rehnquist died. So Roberts replaced Rehnquist instead. Bush then nominated Alito to replace O'Connor who retired because of her husband's illness. Roberts and Alito were put on the court one right after the other.
Those should have been Al Gore's nominations.
