The CDC got spanked for its "conditional" order stopping the cruise industry as well.
11th Circuit reversed that order and told the CDC to go stand in the ****ing corner and not come out till they can play nice.

I would imagine it to be a winner considering the matter already has a favorable ruling from SCOTUS assuming the cause for eviction is legit.

I'm just trying to imagine the courts affirming a penalty on a rule that has already been struck down.

If I was a LL I would absolutely do that. Time to challenge when you are aggrieved and have standing. Even if the government offers to pay that is not the issue. You do not have to accept an insurance settlement if you think it is not in your best interest such as higher premiums in the long run or if it is too low.
Make the justice system enforce the Administrative Agency CDC's diktat.

Of course it isn't. But it didn't stop President Asterisk from doubling down on the mandate by extending it -- yet again.
There is some argument against Kavanaugh for being flimsy in his initial statement that it wasn't constitutional (but it's OK for now and don't do it again, CDC, or we'll take your toys away from you) and that any further extension required legislation. Asterisk basically told SCOTUS to pound sand, I'll do what I want.
Being less than forceful in allowing the moratorium to stand is an invitation for the Dems to keep doing what they habitually do. SCOTUS is even more squishy than establishment republicans.

Kavanaugh created a path for Joe Biden and the CDC to essentially game the system, bankrupting more landlords before any new challenge can make it through the courts. Biden admitted yesterday that is their plan.
