Why doesn't the DOJ indict Trump in Federal Court for inciting insurrection?
Assuming the Republican Senators have no integrity to convict on obvious proof, why not go to court and present the evidence to a court and jury?

remember trump cronies purged the doj of anyone they could who wasn't a believer. It's likely still stacked with assholes and nobody left wants that job.
Plus there is at least one special council out there that would work against any such move.

5. The Trump legal team is in a pickle
They will argue that Trump cannot be tried by the Senate, almost ensuring and validating that the DOJ will. They've chosen poorly.

A unanimous jury plus multiple courts (many of which he selected) unwilling to see first amendment issues?

Demanding proof of a crime is to question the legitimacy and integrity of The State.
That is sedition. Surrender yourself to the nearest Social Worker for mandatory, in-patient counseling.

Especially showing how Trump's speech inspired the events the day before (e.g. the dude planting the bombs at the DNC and RNC HQs).

My first guess is that even Trump-Hating prosecutors don't relish having their cases laughed out of court.
