9th Circuit ends California ban on high-capacity ammunition magazines
SACRAMENTO — A three-judge panel of the 9th U.S. Circuit Court of Appeals on Friday threw out California’s ban on high-capacity ammunition magazines, saying the law violates the U.S. Constitution’s protection of the right to bear firearms.
“Even well-intentioned laws must pass constitutional muster,” appellate Judge Kenneth Lee wrote for the panel’s majority. California’s ban on magazines holding more than 10 bullets “strikes at the core of the Second Amendment — the right to armed self-defense.”
He noted that California passed the law “in the wake of heart-wrenching and highly publicized mass shootings,” but said that isn’t enough to justify a ban whose scope “is so sweeping that half of all magazines in America are now unlawful to own in California.”
California Attorney General Xavier Becerra’s office said it is reviewing the decision and he “remains committed to using every tool possible to defend California’s gun safety laws and keep our communities safe.”

According to the judge. If there are no limits on weapons, I am going to build a nuke in my workshop. I hope the neighbors don't mind.

Go ahead. Should be amusing to see how far you get on your $23.72 in liquid assets, and how much luck you have obtaining the necessary Secret/CNWDI information necessary to get one to work if you somehow manage to blow the millions of dudes necessary for you to buy the materials.

That is damned significant I think. The 9th circus is liberal as hades. When they slap you down, you ain't gotta leg to stand on.
Meanwhile we got us an Enrico Fermi here, gonna build nuclear weapons in his shop. Probably gonna build that in between the IED's he supplies antifa with and the fertilizer bombs he supplies ISIS with.
It's just so hard to keep your demo separated I think he will end up blowing his ass to the moon over a simple mistake.

Because Obama was so fricking lazy about judicial appointments and maybe left some openings for Hillary to fill, Trump has had a greater than average effect on the appeals and district courts in most/all circuits, the Ninth included. And McConnell deserves credit for going thermonuclear on the Dems' attempts to obstruct judicial appointments (should have been done during GWB's Administration, but at least he did it).

I'm sure the communist AG of Kalifornia will request the full 9th Circus to review whaer the low-capacity magazine law will be upheld. Judge traitor Roberts will not take it up at SCOTUS.

The thing is, the 9th Circuit’s decision (2-1, with a Clinton appointee opposing a Bush appointee and a Trump appointee) is in direct conflict with a decision by the 3rd Circuit a couple of years ago. The thought is that SCOTUS will take it up just to settle the whole “equal protection under the law” idea. If they do, it’s going to be a 5-4 decision. No idea how Chief Roberts will vote.

In 2008, Californians overwhelmingly banned gay marriage but the left fought to overturn that. What the people want only matters if it is what the leftists want.

Actually, the decision recognizes that there can be limits. But ruled that higher capacity magazines are ordinary equipment for self-defense and thus protected by the Second Amendment. But as my signature quote says ...
