Title: Seattle Sues Over ‘Sanctuary Cities’ Funding Threat - citing the 10th Amendment
Post by: HAPPY2BME on March 30, 2017, 09:04:34 AM
The city of Seattle on Wednesday announced a federal lawsuit over the Trump administration's threat to withhold federal grants to so-called "sanctuary cities," citing the 10th Amendment that deals with states' rights.

San Francisco has already filed suit against the Trump administration over the executive order, also citing the 10th Amendment.

On Monday, Attorney General Jeff Sessions said the Justice Department would require cities seeking some of $4.1 billion available in grant money to verify that they are in compliance with a section of federal law that allows information sharing with immigration officials.

That's a pretty topsy-turvy argument.  'We have a 10th Amendment right to independence from Federal control of our programs, now give us Federal money to fund them.'

I'm not a lawyer, but it seems to me that this argument is a bit . . . 'spurious.' :whistling:

I don't think even the 9th Circus Court is THAT stupid.

Yes, but that state law was struck down because the court (9th Circuit, IIRC) said that immigration was a Federal function, and not one that was the responsibility of the states.

The law looks clear to me.
